February 3, 1993 REVENUE REGULATIONS NO. 06-93 SUBJECT : Prescribing the Guidelines to Implement the Collection of Qualifying Fees from Players Entering the Casino TO : All Internal Revenue Officers and Others Concerned SECTION 1 . Scope . Pursuant to Section 245 of the National Internal Revenue Code and Executive Order No. 48, these regulations are hereby promulgated prescribing the guidelines to implement the collection of qualifying fees from players entering the casino. SECTION 2 . Basic Features . The qualifying fee shall authorize players to enter the casinos operated by the Philippine Amusement and Gaming Corporation (PAGCOR) subject to its rules and regulations. PAGCOR shall be designated as authorized collection agents of the BIR to collect these fees. The amount of the fee shall initially be one hundred pesos (P100.00). aisa dc SECTION 3 . Printing and requisition of coupons . The BIR shall be responsible for the printing of the coupons. This coupon shall be pre-printed and pre-numbered and shall contain security markings. On a regular basis or as requisitioned by PAGCOR, the BIR shall issue these coupons to an accountable officer of PAGCOR. SECTION 4 . Issuance of coupons to players . A coupon shall be issued to the players entering the casino by an accountable officer of PAGCOR upon payment of the required amount. This coupon is valid only on date of payment and is non-transferable and non-refundable. SECTION 5 . Monitoring and reporting of collections . The BIR shall prescribe the reports to be prepared and submitted by PAGCOR in accounting for the amount of collections. PAGCOR shall institute the necessary procedures to insure the payment of these qualifying fees by all players entering the casino. A duly authorized officer of the BIR having jurisdiction over the place where a casino is located shall perform spot checking of the issuance of these tickets to players on the casino and perform any other procedures to audit these transactions. SECTION 6 . Remittance of collections to the Bureau of Treasury and recording of BIR of the amount of collections . PAGCOR shall issue a check, payable to the Bureau of Treasury and to the credit of the account of the BIR, equivalent to the amount of collections for a particular week. This check, together with the necessary supporting documents prescribed by the BIR, shall be issued to the Bureau of Treasury not later than Tuesday following each week. The Bureau of Treasury shall then prepare monthly the corresponding Journal voucher and any other necessary document in favor of the BIR for the latter to record the amount of collections in its book of accounts. cdt SECTION 7 .
