Assignment of Returns to Investigating Divisions of the Sector Operations Office

January 30, 1981 REVENUE MEMORANDUM ORDER NO. 03-81 SUBJECT : Assignment of Returns to Investigating Divisions of the Sector Operations Office TO : All Revenue Service Chiefs, Regional Directors, Division Chiefs, Revenue District Officers, Fieldmen and Others Concerned To enable the Sector Operations Office to implement effectively the line of business and package audit system of investigation, and in order to avoid conflict of jurisdiction between the different investigation divisions of the said Office and the Regional Offices, this Revenue Memorandum Order is hereby promulgated. I. List of Taxpayers Assigned to the Sector Operations Office : For 1981, all the taxpayers listed in the annexes hereof are hereby assigned to the investigating divisions of the Sector Operations Office enumerated as follows: aisa dc 1. Agriculture & Natural Resources Division Annex "A" 2. Financing, Real Estate and Transfer Tax Division Annex "B" 3. Investment Incentives Division Annex "C" 4. Manufacturing Division I Annex "D" 5. Manufacturing Division II Annex "E" 6. Service and Miscellaneous Tax Division Annex "F" 7. International Operations Division Annex "G" 8. Government & Exempt Corporations Division Annex "H" II. Taxpayers Not Listed : All taxpayers and cases who or which are not listed within the jurisdiction of the divisions of the Sector Operations Office as listed and enumerated above shall be under the jurisdiction of Regional Offices. cdt III. Exception to the Delineation of Jurisdiction : Notwithstanding the delineation of cases that may be handled by the Sector Operations Office and the Regional Offices as herein established, the Commissioner may nevertheless assign the investigation of any taxpayer or group of taxpayer, to another Division, Regional Office, composite team of examiners belonging to various investigative divisions and Regional Offices, or to a particular examiner, if the interests of the service so require, as in the investigation, inter alia , of the following cases: 1. Affiliated companies or interrelated taxpayers including their key officials or stockholders; 2. High salaried executives; 3. Taxpayers engaged in multiple lines of industry or business; 4. Those involving national security; or 5. Reinvestigation. IV. Responsibility and Disciplinary Action of All Personnel Concerned : No revenue official shall issue any letter of authority for the investigation of any taxpayer who is not within the jurisdiction of his office, unless previously authorized by the Commissioner; and no examiner or fieldmen shall perform any investigation of any taxpayer, even if assigned to investigate a taxpayer, in a letter of authority, if he belongs to an office having no jurisdiction on the taxpayer, and he has knowledge of such fact. All personnel making investigations in violation of this Order shall be subject to immediate disciplinary action. V. Segregation and Transmittal of Returns : A. The Assessment Branches in the revenue regions shall segregate the duplicates of the tax returns of the taxpayers within the investigative jurisdiction of the divisions of the Sector Operations Office, and shall transmit the same to the Office of Deputy Commissioner Tomas C. Toledo as soon as possible. casia B. Tax returns of taxpayers within the investigative jurisdiction of the Regional Offices, properly classified, shall be sent to the corresponding investigating units of the Region. VI. Repealing Clause : All other orders, circulars and issuances or portions thereof relative to the investigation of tax cases which are inconsistent with the provisions of this Revenue Memorandum Order are hereby revoked or amended accordingly.
