Immediate Reporting of BIR Personnel Picked-Up for Questioning or Arrested by the Military or Police Authorities, and Those Discovered to Have Committed Serious Offenses

November 8, 1973 REVENUE MEMORANDUM CIRCULAR NO. 57-73 TO : All Department Heads, Regional Directors, Chiefs of Divisions, Revenue District Officers and All Others Concerned SUBJECT : Immediate Reporting of BIR Personnel Picked-Up for Questioning or Arrested by the Military or Police Authorities, and Those Discovered to Have Committed Serious Offenses Many cases of BIR personnel picked up or arrested by either the military or the police authorities were brought to the attention of this Office from sources other than the Chiefs of Offices where the persons involved are assigned. It has also been noted that such persons after their release are allowed to report to their places of assignments by the chief of the office concerned without clearance from this Office. This Office is also aware that in many instances, serious offenses such as malversation, extortion and other forms of dishonesty and violation of civil service rules committed by personnel in the field offices are not reported immediately to this Office or sometimes not reported at all. When discovered by the National Office, it is already too late to take the appropriate disciplinary action or corrective measure. This practice is not only contrary to good management but also inimical to the aims and objectives of the New Society regarding behaviour and performance in the public service. In view hereof, it is hereby directed that: 1. Whenever an official or employee of any Office of this Bureau is picked up or arrested by the military or police authorities, the chief of office concerned must inform this Office immediately by telegram. Within 24 hours after the telegram is sent, a detailed report (in 3 copies) indicating the name and position of the person involved and circumstances surrounding his arrest must be submitted to this Office. 2. Upon release of the person arrested or detained by the military or police authorities, he should not be made to report for duty without the written clearance and authority from this Office for him to report back for duty. 3. Whenever an official or employee is discovered to have committed a serious offense that may warrant his dismissal or suspension, a written formal report (in 3 copies) must be submitted by the Chief of Office concerned to this Office within 72 hours after the discovery. The report must contain the name and position of the person involved, the offense committed and the names of witnesses, if any. Strict compliance with this Circular is urged.
