October 17, 1997 REVENUE MEMORANDUM CIRCULAR NO. 46-97 SUBJECT : Resolution No. 2946 Promulgated on September 16, 1997 by the Commission on Elections In Re: Calendar of Activities and List and Periods of Certain Prohibited Acts in Connection with the May 11, 1998 National and Local Elections TO : All Revenue Officials and Employees and Others Concerned For the information and guidance of all revenue officials and employees, quoted below is Resolution No. 2946 dated September 16, 1997. "RESOLUTION NO. 2946" Pursuant to the above resolution, the Commission on Elections adopts the following CALENDAR OF ACTIVITIES, AND PERIODS OF CERTAIN ACTS for the May 11, 1998 national and local elections. LLjur DATE/PERIOD ACTIVITIES PROHIBITED ACTS COVERED/INVOLVED Ongoing and up to Applications for registration December 22, 1997 under the system of continuing registration (Min. Res. No. 97-2551 dated July 22, 1997). November 12, 1997 Last day for (Wednesday) sector/organization/coalition desiring to participate in the party-list system to register with the COMELEC (Sec. 2 (a) Comelec Resolution No. 2847 dated June 25, 1996). November 27, 1997 Period of nomination of (Thursday) to February 9, official candidates for all 1998 (Monday) elective officials (165 days before election) January 10, 1998 Last day to alter territory of (Saturday) an election precinct or to establish a new precinct (Sec. 5, R.A. 8189). January 11, 1998 Last day for appointment of (Sunday) members of the Boards of Election Inspectors subject to changes on account of lack of public school teachers and disqualifications due to relationship to candidates (Sec. 164, OEC in relation to Sec. 31, R.A. 8189). Start of period for filing certificates of candidacy for all elective positions (Sec. 75, OEC). January 11, 1998 (Sunday) ELECTION PERIOD No alteration of territory of to June 10, 1998 a precinct or establishment (Wednesday) of a new precinct (Sec. 5, (120 days before election R.A. 8189). and 30 days thereafter) No carrying of firearms/deadly weapons, including wearing of uniforms, insignias, etc. (Sec. 261 (p), (q), (s), OEC, as amended by Sec. 32, R.A. No. 7166). No transfer or detail of officers and employees in the civil service, including public school teachers (Sec. 261 (h), OEC). No organizing or maintaining reaction/strike forces or similar forces (Sec. 261 (u), OEC). No use of security personnel or bodyguards by candidates, whether or not such bodyguards are regular members or officers of the PNP or AFP or other government law enforcement agency (Sec. 261 (t), OEC, as amended by Sec. 33, R.A. 7166). No suspension of any elective provincial, city, municipal or barangay officials (Sec. 261 (x) OEC). Not later than January 25, Filing of petitions for 1998 (Sunday) exclusion of non-qualified registrants or inclusion of qualified voters in the List with the proper Municipal or Metropolitan Trial Courts for those whose applications for registration have been disapproved by the Board or whose names have been stricken out from the list (except 105 days prior to election) (Sec. 34, R.A. No. 8189). January 26, 1998 (Monday) Notice of inspection and to February 09, 1998 verification of completeness (Monday) (15 day period of the VRRs for each before start of campaign precinct compiled in the period for President, Vice- book of voters, and conduct President and Senators) of verification and inspection of completeness of books of voters (Sec. 31, R.A. 8189 as implemented by Sec. 46, Comelec Resolution No. 2904, dated 14 March 1997). February 10, 1998 No giving of donation or (Tuesday) to May 11, gift in cash or in kind, etc. 1998 (Monday) (Sec. 104, OEC). February 25, 1998 Last day to prepare certified (Wednesday) list of parties, organizations or coalitions participating under the party-list system (Sec. 7, Comelec Resolution No. 2847 dated June 25, 1996). February 28, 1998 Last day for filing certificate of candidacy for congressional and local positions. March 12, 1998 (Thursday) No release of prisoners to June 10, 1998 (Sec. 261 (n) OEC). (Wednesday) (60 days before election and 30 days thereafter) March 27, 1998 (Friday) to Campaign period for May 9, 1998 (Saturday) Members of the House of (Starting 45 days before Representatives and election) elective provincial, city and municipal officials (Sec. 5, R.A. 7166). Not later than March 27, Submission to the 1998 (Friday) (45 days Commission by heads of all before election) reaction forces, strike forces or similar forces of a complete list of all members thereof with such particulars as the Commission may require (Sec. 261 (u) OEC). March 27, 1998 (Friday) to No appointment or hiring of May 10, 1998 (Sunday) (45- new employees (Sec. 261 day period before election) (g) OEC). No creation or filling of new position (Sec. 261 (g) OEC). No promotions or giving of salary increases, remuneration or privilege (Sec. 261 (g) OEC). April 9 (Maundy Thursday) No Campaigning to April 10, 1998 (Good Friday) April 11, 1998 (Saturday) Last day to close and seal (30 days before election) the book of voters (Sec. 46, Comelec Resolution No. 2904, dated March 14, 1997). Last day to furnish every registered voter with an official sample ballot, voters information sheet (VIS) and list of all national, provincial and city candidates to be voted in the election (Sec. 1, R.A. 7904). May 9, 1998 (Saturday) Last day of campaigning for all positions. May 10, 1998 (Sunday) No campaigning (Sec. 3, EVE OF ELECTION OEC). DAY No selling, furnishing, offering, buying, serving or taking intoxicating liquor (Sec. 261 (dd) (1) OEC). No giving, accepting free transportation, foods, drinks and things of value (Sec. 89 OEC). May 11, 1998 (Monday) ELECTION DAY No campaigning (Sec. 3 OEC). CASTING OF VOTES (7:00 A.M. to 3:00 P.M.) No selling, furnishing, offering, buying, serving or taking intoxicating liquor (Sec. 261 (dd) (1) OEC). No giving, accepting free transportation, food, drinks and things of value (Sec. 89 OEC). No voting more than once or in substitution of another (Sec. 261 (z) (2) and (3) OEC). No holding of fairs, cockfights, boxing, horse races or similar sports (Sec. 261 (dd) (3) OEC). No opening of booths, or stalls for the sale, etc., of merchandise, refreshments, within thirty (30) meters radius from polling place (Sec. 261 (dd) (2) OEC). May 11, 1998 (Monday) Convening of City/ 6:00 P.M. Municipal and Provincial Boards of Canvassers. May 12, 1998 (Tuesday) to Filing of sworn statements June 10, 1998 (Wednesday) of election contributions and expenditures (Sec. 14, R.A. 7166).
