September 17, 1965 REVENUE MEMORANDUM CIRCULAR NO. 31-65 SUBJECT : Teaching After Office Hours by Revenue Officers and Employees TO : All Internal Revenue Officers and Employees Concerned Hereunder quoted for the information, guidance and compliance of all concerned is the Memorandum Circular No. 31, series of 1965, dated August 30, 1965 of the Commissioner of Civil Service: cdti "It has come to the attention of this Office that many officers and employees who have been permitted to teach after office hours have abused the privilege, by teaching either in government schools, colleges or institutions for which they are being paid, in violation of the Constitutional provision against double compensation, or in private schools, colleges or universities for more than the number of hours allowed, in violation of the permission granted them. Worse still, some of these officers and employees have been teaching without the requisite permission at all, in violation of Section 12 of Civil Service Rule XVIII, and/or even teaching during office hours in violation of Civil Service Rule XV. "Thus, it can be seen the privilege is not only being abused but that it could easily lead to graver offenses as falsification of time records. Moreover, there is a tendency among officers and employees teaching outside of office hours to give their teaching jobs more importance and preferential attention, especially during examination week, to the detriment of the public interest. "In view thereof and pursuant to the powers and duties vested in the Commissioner of Civil Service under Republic Act 2260, which, among others, are: "Sec. 16. Powers and Duties of the Commissioner of Civil Service . It shall be among the powers and duties of the Commissioner of Civil Service '(b) To enforce, execute and carry out the constitutional and statutory provisions on the merit system: '(f) To make investigations and special reports upon all matters relating to the enforcement of the Civil Service Law and Rules; to inspect and audit the agencies' personnel work programs to determine compliance with the Civil Service Law, rules, standards and other requirements; and to take corrective measures when unsatisfactory situations are found: cdt '(i) Except as otherwise provided by law, to have final authority to pass . . . upon all matters relating to the conduct, discipline and efficiency of such officers and employees ; and to prescribe standards, guidelines and regulations governing the administration of discipline ." (Emphasis supplied) all permission and/or authority to teach after office hours previously granted officers and employees are hereby revoked effective upon the close of the first semester of the current school year (1965-'66), except those involving contracts between the government employee-teacher and the educational institution, in which case the authority is deemed revoked upon the termination of the contract, unless in the meantime such permission and/or authority is renewed by this Office. Officers and employees affected are hereby directed to submit anew their application to teach thru the proper Department Head to this Office for screening. "Henceforth, all such applications to teach shall be submitted to this Office thru the proper Department Head for approval." As directed in the adverted circular of the Civil Service Commission, the permission and/or authority granted to all revenue officers and employees to teach after office hours are revoked effective at the close of the first semester of the school year 1965-'66, except those with contracts with the educational institution involved unless in the interregnum, such permission and/or authority has been renewed by the Civil Service Commission; and those affected are urged to submit new applications to teach to the Civil Service Commission thru the Secretary of Finance for screening. Considering the tendency of some of those granted permission and/or authority to teach to neglect their official duties to the detriment of the public interest, it shall henceforth be the policy of this Bureau to sparingly recommend to the Civil Service Commission thru the Secretary of Finance the approval of requests to teach outside of office hours.
