July 6, 2022 REVENUE MEMORANDUM CIRCULAR NO. 101-2022 SUBJECT : Publishing the Daily Minimum Wage Rates in CARAGA (Region XIII) under Wage Order No. RXIII-17 TO : All Internal Revenue Officials, Employees and Others Concerned For the information and guidelines of all internal revenue officers, employees and others concerned, we are publishing Wage Order No. RXIII-17 which was issued on May 17, 2022 and published at Mindanao Daily on May 21, 2022: Republic of the Philippines Department of Labor and Employment National Wages and Productivity Commission REGIONAL TRIPARTITE WAGES AND PRODUCTIVITY BOARD XII WAGE ORDER NO. RXIII-17 PROVIDING FOR A MINIMUM WAGE INCREASE IN REGION-XIII WHEREAS , the Regional Tripartite Wages and Productivity Board-XIII is mandated under Republic Act No. 6727, otherwise known as The Wage Rationalization Act , to periodically assess wage rates and conduct continuing studies in the determination of the minimum wage applicable in the region or industry; WHEREAS , the current Wage Order No. RXIII-16 took effect on 01 May 2019 ; WHEREAS , pursuant to Section 3(A), Rule II of the Omnibus Rules in Minimum Wage Determination , and in the absence of any petition for a minimum wage adjustment filed, the Board decided motu proprio to initiate wage review; WHEREAS , on 07 April 2022, the Board caused to be published a notice of public hearing in a local newspaper of general circulation to inform the general population of the intent to look into adjustments in the current minimum wage rate; WHEREAS , on even date, the Board received a petition from the Trade Union Congress of the Philippines (TUCP), asking for a Php425.00 wage adjustment for all minimum wage earners in the region; WHEREAS , after due notice to all stakeholders, the Board conducted consultation and public hearings, as follows: Consultation: Date Location 05 April 2022 Watergate Hotel, Butuan City Public Hearings: Date Stakeholder Venue 25 April 2022 Province of Agusan del Sur Mabe's Savory Place, San Francisco, Agusan Del Sur 26 April 2022 Province of Surigao del Sur Kuya Dong's Restaurant, Bislig City, Surigao del Sur 27 April 2022 Province of Surigao del Sur Villa Maria Luisa Hotel, Tandag City, Surigao del Sur 28 April 2022 Province of Surigao del Norte and Province of Dinagat Islands Philippine Gateway Hotel, Surigao City, Surigao del Norte 29 April 2022 Butuan City and Agusan del Norte Almont Inland Resort, Butuan City WHEREAS , on the above dates of public hearings, the petition filed by TUCP was also presented and considered for discussion; WHEREAS , in setting the minimum wage, the Board has to consider the various criteria under Republic Act No. 6727 , as well as the guidelines on the Two-Tiered Wage System ; WHEREAS , after a thorough review and evaluation of the existing socio-economic conditions in the region, the following findings were established: a. The Consumer Price Index in the region was 101.9 in May 2019 and rose to 115.1 in April 2022; b. The poverty threshold based on the latest available data provided by the Philippine Statistics Authority (PSA) for an average family size of 5 is at Php348; c. The poverty incidence among families in the region is 24.1% based on the 2018 Family Income and Expenditure Survey; WHEREAS , the Caraga Region is still in the process of recovering from the damages and losses caused by typhoon Odette; WHEREAS , the typhoon Odette hardest hit areas, the Province of Dinagat Islands, Province of Surigao del Norte including Siargao Islands, are included in the Caraga Region Rehabilitation and Recovery Plan; WHEREAS , after due consideration of the results of the consultations and public hearing, and a thorough review and evaluation of the existing socio-economic conditions in the region, as well as the damages and losses caused by natural calamities which hit the region, the Board agrees to adjust the prevailing daily wage rates of workers/employees in the Region to enable them to cope with the rising cost of living without impairing the viability of business and industry; NOW THEREFORE , by virtue of the power and authority vested under RA No. 6727, RTWPB- XIII hereby issues this Wage Order. Section 1. Integration of COLA . The Php15.00 Cost of Living Allowance (COLA) provided for in Wage Order No. RXIII-16 shall be integrated to the daily basic wage. Section 2. Amount of Increase . The minimum wage earners in the private sector in Caraga Region-XIII shall receive an increase of Php30.00 in basic wage per day. Section 3. New Minimum Wage Rate . The new daily minimum wage rate in Caraga Region- XIII shall be as follows: A. Butuan City, Province of Agusan del Norte, Province of Agusan del Sur and Province of Surigao del Sur Sectors/Industry Minimum Wage Rate under Wage Order RXIII-16 Integration of COLA to the Basic Wage New Wage Increase New Minimum Wage Rate Effectivity Non-Agriculture Basic: Php305.00 COLA: Php 15.00 Php320.00 Php30.00 Php350.00 Upon the effectivity of Wage Order No. RXIII-17 Agriculture Service/Retail Establishment Manufacturing B. Province of Dinagat Islands, Province of Surigao del Norte including Siargao Islands Sectors/Industry Minimum Wage Rate under Wage Order RXIII-16 Integration of COLA to the Basic Wage New Wage Increase New Minimum Wage Rate Effectivity Non-Agriculture Basic: Php305.00 COLA: Php15.00 Php320.00 Php30.00 Php350.00 Php20.00 shall take effect upon the effectivity of Wage Order No. RXIII-17. The balance of Php10.00 shall take effect on September 01, 2022. Agriculture Service/Retail Establishment Manufacturing Section 4. Basis of Minimum Wage Rates. The minimum wage rates prescribed under this Order shall be for the normal working hours which shall not exceed eight (8) hours of work a day. Section 5. Covered . The wage increase prescribed herein shall apply to all minimum wage earners in the private sector within the region, regardless of their position, designation or status and irrespective of the method by which their wages are paid. Section 6. Penal Provision . Any person, corporation, trust, firm, partnership, association or entity who refuses or fails to pay the prescribed increase shall be dealt with pursuant to the provisions of Section 12 of RA No. 6727, as amended by RA No. 8188. Section 7. Effectivity . This Wage Order shall take effect after fifteen (15) days from its publication in a newspaper of general circulation. APPROVED. This 17th day of May, 2022.
