March 31, 1975 REVENUE MEMORANDUM CIRCULAR NO. 09-75 SUBJECT : Submission by Public Officers of Statement of Assets, Liabilities and Net Worth TO : All Internal Revenue Officers and Others Concerned For the information and guidance of all concerned, there is published below the provisions of Letter of Instructions No. 262 dated March 31, 1975: "LETTER OF INSTRUCTIONS No. 262 "TO : ALL HEADS OF DEPARTMENTS, AGENCIES AND OFFICES OF THE GOVERNMENT AND OTHERS CONCERNED "SUBJECT : Submission by Public Officers of Statement of Assets, Liabilities and Net Worth as of December 31, 1974 "In pursuance of the program of reform in the Government under the New Society which was, among others, overwhelmingly endorsed by the people in the referendum held on February 27, 1975, and consistent with the guarantees provided in the different tax amnesty decrees, it is hereby directed that "1. Every public officer shall prepare and file, in the prescribed form (Annex "A") a sworn statement of assets, liabilities and net worth as of December 31, 1974, which shall include the assets, liabilities and net worth of the spouse and unmarried children below twenty-one years of age as of that date; Provided, That every public officer who is a. A chief of section or above; or b. occupying a position allocated to range 51 or above, whether chief of section or not; or c. holding the rank of sergeant or above, in case of the military; or d. an officer or member of a law enforcement agency of the government shall prepare and file, in the prescribed form (Annex "B"), a sworn comparative statement of assets, liabilities and net worth, as provided in Paragraph 2 hereof, which shall also include the assets, liabilities and net worth of the spouse and unmarried children below twenty-one years of age. "2. The comparative statement required in Paragraph 1 hereof shall consist of: "a. A statement of assets, liabilities and net worth as of December 31, 1974; and "b. A statement of assets, liabilities and net worth as of December 31, 1965, or as of the date the public officer entered the government service, whichever date is later; Provided, That in case the public officer had availed of tax amnesty, the statement of assets, liabilities and net worth shall be as of "(1) December 31, 1971, if the public officer availed of tax amnesty under Presidential Decree No. 23 only; or "(2) December 31, 1972, if the public officer availed of the tax amnesty under Presidential Decree Nos. 23 and 157, and/or Presidential Decree Nos. 213 and 370; or "(3) December 31, 1973, if the public officer availed of the tax amnesty under Presidential Decree No. 631. "3. The comparative statement of assets, liabilities and net worth shall be accompanied by a statement, also under oath, showing and explaining any increase in net worth for the period covered by the comparative statement. "4. The statement of assets, liabilities, and net worth shall be filed on or before May 30, 1975, with the office of the corresponding Department Head, or in the case of a Head of Department or Chief of an independent office, with the Office of the President. "5. The following terms as used herein shall be defined as follows: "a. "Government" includes the national government, the local governments, the government owned and government controlled corporations, and all other instrumentalities or agencies of the Republic of the Philippines and their branches. "b. "Public Officer" includes elective and appointive officials, including barangay heads, and employees, permanent or temporary whether in the classified or unclassified or exempt service receiving compensation, even nominal, from the government as defined in the preceding subparagraph. "c. "Assets" include any property, real or personal, tangible or intangible, wherever situated, to the extent of the cost or interest therein of the public officer, his spouse and unmarried children below twenty-one years of age. "d. "Liabilities" are legitimate and enforceable obligations reducible in terms of money and existing as of the date of the statement of assets, liabilities and net worth required herein. "e. "Net Worth" is the difference between the total assets and the total liabilities. "6. Any public official who fails to file the statement required by this Letter of Instructions shall be subject to the penalties provided for in Section 9(b) of Republic Act No. 3019, otherwise known as the Anti-Graft and Corrupt Practices Act. MARCOS President of the Philippines" Features of the Letter of Instructions 1. Under Section 1, all public officers shall prepare and file in the prescribed form (Annex A), the sworn statement of assets, liabilities and net worth as of December 31, 1974. 2. The statement shall include the assets, liabilities and net worth of the spouse and unmarried children below 21 years of age as of December 31, 1974. 3. "Public Officer" as defined in Section 5 of the Letter of Instructions includes employees, permanent or temporary, whether classified or unclassified or exempt service, receiving compensation, even nominal, from the government. All employees, therefore, of the Bureau of Internal Revenue including emergency employees shall file the statement of assets, liabilities and net worth. 4. The nature of the assets, liabilities and net worth to be reported are defined in Section 5 of the Letter of Instructions. 5. If the public officer is a Chief of Section or above or is occupying a position allocated to range 51 or above, whether Chief of Section or not, he shall prepare and file in the prescribed form (Annex B), a sworn comparative statement of assets, liabilities and net worth which shall also include the assets, liabilities and net worth of the spouse and unmarried children below 21 years of age. 6. If the employee is required to file as stated above the comparative statement (Annex B) he need not file the prescribed form known as Annex A . 7. For the guidance of the employees of the Bureau, "Annex D" is enclosed which contains the position titles of employees with range 51 and above under Presidential Decree No. 640. 8. Employees whose present items are not included in "Annex D" shall nevertheless file the comparative statement if their annual salaries at present amounts to P7,236.00 or more. 9. In the comparative statement, the net worth as of December 31, 1974 will be the basis of comparison with the previous net worth detailed hereunder: a. If the employee is in the public service before December 31, 1965, then the net worth as of December 31, 1965 shall be the beginning net worth; However, if he entered the public service after December 31, 1965, then as of the time he entered the service. The statement of assets, liabilities and net worth required to be filed by employees entering the service may be used as guide in the preparation of the beginning net worth. b. If the employee filed a tax amnesty return under Presidential Decree No. 23 only, the beginning net worth shall be that as of December 31, 1971. c. If the employee availed of the tax amnesty under Presidential Decree Nos. 23 and 157 and/or Presidential Decree Nos. 213 and 370, then the beginning net worth shall be that as of December 31, 1972. d. If the employee availed of the tax amnesty under Presidential Decree No. 631, as amended, then the beginning net worth shall be that of December 31, 1973. 10. The comparative statement shall also be accompanied by a sworn statement explaining any increase in net worth for the period covered by the comparative statement using the prescribed form (Annex C). 11. The statement of assets, liabilities and net worth (Annex A or Annex B), together with the statement explaining the increase in net worth (Annex C) shall be filed in duplicate on or before May 30, 1975 with the Revenue District Officer, in case of employees in the District Office; with the Regional Director, in case of employees in the Regional Office; and with the Personnel Officer, in case of employees in the National Office. 12. Regional Directors and Revenue District Officers are hereby instructed to forward immediately to the National Office the statements of assets, liabilities and net worth filed by the employees in their respective offices direct to the Personnel Officer accompanied by a listing of the employees who filed the statements which are being transmitted as well as the employees who did not file as of May 30, 1975. 13. The Personnel Officer shall compile all these statements making a listing thereof and checking with the roster of employees to determine those who have not filed. 14. The list of those who did not file shall be immediately forwarded to the Internal Audit Department for appropriate action in accordance with the provisions of Section 6 of the Letter of Instructions which provides that any public official who fails to file the statements required by the Letter of Instructions shall be subject to the penalties provided for in Section 9-B of Republic Act 3019, otherwise known as the Anti-Graft and Corrupt Practices Act. 15. The statements shall be segregated in the Personnel Division, the originals of which shall be forwarded to the Office of the Secretary of Finance accompanied with the proper listings and the duplicates shall be filed in the 201 folder of the employee concerned.
