February 15, 1962 REVENUE MEMORANDUM CIRCULAR NO. 03-62 SUBJECT : Dissemination of the Contents of the Memorandum Circular of the Acting Secretary to All Chiefs of Bureaus and Offices Under the Department of Finance TO : All Internal Revenue Officers, Employees and Others Concerned For the information, guidance and compliance of all officers and employees of the Bureau of Internal Revenue, there is quoted hereunder the Memorandum Circular of the honorable, the Acting Secretary of Finance dated January 5, 1962, which is self-explanatory: "SUBJECT : Notification to employees about their reaching the compulsory retirement age of 65 and their filing of assets and liabilities under the Anti-Graft and Corrupt Practices Act. "The attention of the heads of bureaus & offices under this Department, division chiefs and treasurers and assessors of local governments is called to the pertinent provision of Memorandum Circular No. 30 dated September 15, 1961 of the Office of the President 'ENJOINING AGAINST THE CONTINUANCE IN THE SERVICE OF OFFICIALS AND EMPLOYEES BEYOND THE DUE DATE OF THEIR AUTOMATIC AND COMPULSORY RETIREMENT' quoted as follows: 'WHEREFORE, heads of departments and chiefs of bureaus and offices, including provincial, municipal and city governments and corporations owned or controlled by the Government, are hereby enjoined not to allow any of the officials and employees under them to continue in the service beyond the date he becomes due for automatic and compulsory retirement pursuant to the provisions of the aforementioned Sections 12(e) of Commonwealth Act No. 186, as amended. Particular attention is invited to the last portion of the said Section which provides that 'it shall be the duty of the employer concerned to notify each such employee under its direction of the date of his automatic separation from the service at least sixty days in advance thereof.' It is, therefore, hereby directed that this legal duty be strictly complied with, otherwise the said heads of departments and chiefs of bureaus and offices, including provincial, municipal and city governments and corporations owned or controlled by the Government, shall be held personally responsible for the salaries that may be paid to officials and employees under their direction for service rendered beyond the due date of their automatic separation from the service.' "It is thus hereby directed that the heads of offices concerned attend to the preparation of the advice to the employees under their respective offices at least sixty (60) days before the employees concerned reach the age of 65. "The employees who are leaving the service shall be required, under the provisions of Section 7 of the Anti-Graft and Corrupt Practices Act, approved August 17, 1960, to file their statements of assets and liabilities at the time they file their applications for leave preparatory to retirement or resignation. In accordance with the same provision, a true detailed and sworn statement of Assets and Liabilities shall also be filed by every public officer '. . . within thirty (30) days after the approval of this Act or after assuming office, and within the month of January of every other year thereafter . . .,' (Emphasis supplied) including a statement of the amounts and sources of his income, the amounts of his personal and family expenses and the amount of income taxes paid for the next preceding calendar year.
