February 15, 1962 REVENUE MEMORANDUM CIRCULAR NO. 02-62 SUBJECT : Dissemination of the Contents of Circular No. 104 of the General Manager, Government Service Insurance System to Heads of Departments, Chiefs of Bureaus and Offices, Managing Heads of Government Owned or Controlled Corporations, Provincial Governors, City and Municipal Mayors, Provincial, City and Municipal Treasurers and Others Concerned TO : All Internal Revenue Officers, Employees and Others Concerned For the information, guidance and compliance of all officers and employees of the Bureau of Internal Revenue, there is quoted hereunder Circular No. 104 of the General Manager, Government Service Insurance System, which is self-explanatory. "SUBJECT : Extension of time for filing preference for retirement benefits under CA 186, as amended. "For the information of all employees concerned, there is quoted hereunder a pertinent provision of RA No. 3096, further amending CA No. 186: 'SEC. 28. Miscellaneous provisions . (a) . . . and Provided, finally, That such a member shall be entitled to the retirement benefits described in this Act only if he so notifies the System on or before December thirty-one, nineteen hundred and sixty-two, otherwise it shall be deemed that he does not desire to be retired under this Act and accordingly the gratuity or benefit payable to him under the law or retirement or pension plan mentioned above shall be exclusively reserved for him by the System. The extension of time herein provided shall not be applicable to those already retired. . .' "Conformably with the above-quoted provision of law, any employee who is still in the service and had established his right to retire under Act 2589, otherwise known as the Osmea Act, or any previous retirement Act and had not notified the System of his preference for the retirement benefits of CA 186, as amended, before December 31, 1952, deadline previously fixed under the law for the submission of such notice to the System, should notify the GSIS in writing of his preference to retire under the latter Act not later than December 31, 1962 if he desires to be retired thereunder . Upon election to retire under CA 186, as amended, retirement premiums should be paid immediately every month thru salary deduction. It should be understood that the period from June 16, 1951, during which premiums were not paid, shall not be included in the computations of the aggregate service unless the corresponding premiums, with interest, are paid, attention being invited to Section 13 of CA 186, as amended, pertinent portion of which reads: 'Section 13. Computation of Service . . . . Provided, also, That periods of service rendered after June sixteen, nineteen hundred fifty-one, during which premiums are not required shall be excluded, unless the premiums corresponding to said service be later on paid to the System with interest: . . .'
