SP-2148-12 PO2011-152 55th Regular Session AN ORDINANCE RECLASSIFYING AND/OR CONVERTING THE ZONING CLASSIFICATION OF CERTAIN REAL PROPERTY LOCATED AT THE BACK PORTION OF EVER GOTESCO MALL-COMMONWEALTH BRANCH, BARANGAY BATASAN HILLS, QUEZON CITY, REGISTERED IN THE NAME OF AZ 17/31 REALTY, INC. AND COVERED BY TRANSFER CERTIFICATE OF TITLE NO. N-323794 OF THE REGISTRY OF DEEDS OF QUEZON CITY CONTAINING AN AREA OF FORTY THREE THOUSAND NINE HUNDRED NINETY SIX (43,996) SQUARE METERS, FROM MEDIUM-DENSITY RESIDENTIAL ZONE (R-2) TO METROPOLITAN COMMERCIAL ZONE (C-3) Introduced by: Councilor Ranulfo Z. De Guzman WHEREAS, the Quezon City Council, in the exercise of its legislative power, has enacted Ordinance No. SP-918, S-2000, otherwise known as the Quezon City Comprehensive Zoning Ordinance, designating the areas of Quezon City for its specific uses; DcTSHa WHEREAS, under Section 458 (a) (2) (viii) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, the City Council may reclassify the land within the jurisdiction of the city . . .; WHEREAS, considering the fast and remarkable development in certain parts of Quezon City, there is an imperative need to change or update the zoning classification thereof to upgrade its property value, increase business potential, and to conform with its actual uses; WHEREAS, it has been observed that a certain real property situated at the back portion of Ever Gotesco Mall-Commonwealth Branch registered in the name of AZ 17/31 Realty, Inc. and covered by Transfer Certificate of Title No. N-323794 of the Registry of Deeds of Quezon City, with an area of Forty Three Thousand Nine Hundred Ninety Six (43,996) Square Meters, which is currently classified as Medium-Density Residential Zone (R-2) pursuant to the provisions of the said Quezon City Comprehensive Zoning Ordinance, has acquired the character of a Metropolitan Commercial Zone (C-3) since the same and its adjacent or adjoining properties are actually being used for commercial purposes; WHEREAS, the said property is adjacent, contiguous and nearest to Ever Gotesco Mall-Commonwealth Branch and is likewise surrounded by public highways like Commonwealth Avenue and Don Antonio Drive, commercial areas and multi-level structures like Royale Place where a mixture of retail and wholesale trade, service and entertainment businesses, light industrial activities, and other prominent establishments are operating; WHEREAS, due to its proximity to the said shopping mall, multi-level structure, public highways, and other commercial establishments, the above-described real property becomes economically feasible and sound for business activities and would have a substantially greater economic value for commercial purposes; WHEREAS, the reclassification and/or conversion of the subject real property into a Metropolitan Commercial Zone (C-3) will not only develop the property to become a business zone and tourist destination, but would certainly generate employment opportunities for the barangay and city residents; CTSAaH WHEREAS, under Section 2 (b) (3) of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992, it shall be the policy of the State to undertake a development of urban areas conducive to commercial and industrial activities which can generate more economic opportunities for the people; WHEREAS, the Sangguniang Barangay of Barangay Batasan Hills who has jurisdiction over the said property has favorably endorsed to the City Council the reclassification or conversion thereof through its Resolution No. 110, S-2011 adopted and approved on July 26, 2011. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED: SECTION 1. The zoning classification of certain real property located at the back portion of Ever Gotesco Mall-Commonwealth Branch, Barangay Batasan Hills, Quezon City, registered in the name of AZ 17/31 Realty, Inc. and covered by Transfer Certificate of Title No. N-323794 of the Registry of Deeds of Quezon City containing an area of Forty Three Thousand Nine Hundred Ninety Six (43,996) Square Density Residential Zone (R-2) to Metropolitan Commercial Zone (C-3). SECTION 2. All permitted uses in Minor (C-1) and Major (C-2) Commercial Zones, including department stores, shopping malls/centers, commercial and sports complexes/areas, and other commercial/business activities not elsewhere classified as mandated in the Quezon City Comprehensive Zoning Ordinance shall be allowed in the real property reclassified in Section 1 hereof. SECTION 3. The existing business establishments operating in the reclassified real property are hereby given a grace period of one (1) year to conform the nature of their business to the new zoning classification as well as their business permits. Non-compliance thereto shall result to the revocation or non-renewal of the business permits. TcSaHC SECTION 4. The Vicinity Map prepared by the City Planning and Development Office (CPDO) of Quezon City describing the location of the reclassified real property shall be attached to form an integral part of this ordinance. SECTION 5. All ordinances, resolutions, executive orders and other administrative issuances found to be inconsistent with the provisions of this ordinance are hereby repealed and/or modified accordingly. SECTION 6. If any provision or provisions of this ordinance is/are declared invalid or unconstitutional by a competent court, the remaining portion not affected thereby shall continue to be in full force and effect. SECTION 7. This ordinance shall take effect ten (10) days after its publication in a newspapers of general circulation. ENACTED: March 26, 2012. (SGD.) MA. JOSEFINA G.
