January 27, 2020 Excerpts from the Journal of Proceedings of the 29th Regular Session of the 16th Sangguniang Panlungsod of the City of Puerto Princesa Held on January 27, 2020 at the Session Hall of the Sangguniang Panlungsod. PUERTO PRINCESA CITY ORDINANCE NO. 1038 AN ORDINANCE AMENDING SECTIONS 4A.06 (F) AND 4A.08, ARTICLE A, CHAPTER IV OF ORDINANCE NO. 794, OTHERWISE KNOWN AS THE REVISED REVENUE CODE OF PUERTO PRINCESA CITY OF 2016 Sponsored by: Committee on Legal Matters BE IT ORDAINED , by the Sangguniang Panlungsod of Puerto Princesa in session assembled, that: HTcADC SECTION 1. Section 4A.06 (F) is hereby amended to read, as follows: "Section 4A.06(F). Posting of permit and business plate. Every permittee shall keep his permit and business plate conspicuously posted in plain view at all times in his principal place of business or office. Non-posting shall be penalized with administrative fine of One Thousand Pesos (P1,000.00) for every instance of non-posting upon inspection of the BPLO . Such revocation shall operate to forfeit all sums which may have been paid in respect of said privilege, in addition to the fines and imprisonment that may be imposed by the court for violation of any provision of this code or ordinance governing the establishment and maintenance of businesses and to prohibit the exercise thereof by the person whose privilege is revoked, until restored by the Sangguniang Panlungsod." SECTION 2. Section 4A.08 is hereby amended to read as follows: "Section 4A.08. Any violation of any provisions of this article shall be penalized as follows: 1. Imposition of Administrative Fines upon discovery that operation of business is being conducted without a Mayor's Permit: 1. 1st Offense Failure to secure Mayors Permit for Thirty (30 days) from the receipt of notice P1,500.00 in addition to permit interest and surcharges; 2. 2nd Offense Failure to secure Mayors Permit for Twenty (20 days) from the receipt of notice P2,500.00 in addition to permit interest and surcharges; 3. Failure to secure Mayors Permit for Fifteen (15 days) from receipt of notice P5,000.00 in addition to permit interest and surcharges; 4. Failure to secure Mayors Permit will result to closure of establishment (endorsed to the City Legal Office) Summary closure of the erring establishment." SECTION 3. Repealing Clause . The provisions of all local ordinances, resolutions, memoranda, circulars, and other issuances which are inconsistent with this Ordinance are hereby repealed or modified accordingly. SECTION 4. Effectivity . This Ordinance shall take effect fifteen (15) days following its full publication in a newspaper of local circulation in the City of Puerto Princesa. SO ORDAINED.
