WRIT OF ATTACHMENT TO : ARTURO C. FLORES Deputy Sheriff GREETINGS : WHEREAS, International Exchange Bank, with principal office at Salcedo Towers, 169 H. V. dela Costa Street, Salcedo Village, Makati City, has complained on oath to Zeus C. Abrogar, Presiding Judge of Branch 150, Regional Trial Court, Makati City, that defendant Alberto T. Looyuko, a resident of No. 225 to 227 Country Club Drive, Ayala Alabang Village, Muntinlupa City, Metro Manila, doing business under the name and style of Noah's Ark Sugar Refinery, Noah's Ark Sugar Holdings, and Noah's Ark Merchandising, all with common business address at 2/F Noah's Building, Escolta Street, Manila, had applied, through its President and General Manager, defendant Jimmy T. Go (A.K.A. Jaime T. Gaisano), whose address is at No. 8 Cattleya Street, Valle Verde Subdivision, Pasig City, and was granted an Omnibus Credit Line; that in order to secure the said obligation, defendants Alberto T. Looyuko and Jimmy T. Go executed a Surety Agreement dated December 21, 1995 wherein they obligated and bound themselves to be solidarily liable with the plaintiff; that said financial obligation was also covered by six (6) trust receipts; that defendants, however, failed to account for and to deliver to the plaintiff the proceeds of the sale of the sugar quedans subject matter of the trust receipts; that in furtherance of their deceit, defendants even posted as additional security a real property in Escolta, Manila, knowing all the while that the same had already been used as collateral for another loan from some other party, thus, both defendants are guilty of fraud; cdt WHEREAS, security has been given by the plaintiff, according to the Rules of Court of the Philippines, in the form of Plaintiff's Bond issued by UCPB General Insurance Co., Inc. under UGIC Bond No. JCL(4) 0037, dated April 7, 1998, in the amount of P103,680,000.00. I, THEREFORE, command you that you attach the estate, real and personal, of the said defendants that may be attached pursuant to the Rules, to the value of the said demands and costs of suit and that you safely keep the same according to these Rules, unless the defendants give security to pay such judgment as may be recovered in the said action in the manner provided by the Rules of Court, and return this writ with your proceedings endorsed thereon.
