April 6, 1999 PSE CIRCULAR FOR BROKERS NO. 666-99 April 3, 1999 PNP SPECIAL ACTION FORCES RUSHED TO CLARK AS LASTIMOSO CONTINUES TO DEFY SC TRO Philippine National Police Special Action Forces from Rizal province were deployed at Clark in a bid to reinforce PNP units at the Mimosa Leisure Estate. Meanwhile, business went on as usual at the leisure estate as the Holiday Inn Hotel, the Mimosa Golf and Country Club and the Monte Vista Hotel were swarmed with thousands of guests during the Holy week. MLRC's Resort Resident Manager Bill Hand said that despite the presence of PNP men, those Mondragon-controlled establishments have reported a 100% occupancy rate. This has prompted Mondragon to prepare to press the Supreme Court to order the arrest and detention of Lastimoso and Colayco until they comply with the order of the Supreme Court. Accordingly to Mondragon Lawyer Ernesto B. Francisco, Jr., this is allowed under the Rules of Court precisely to ensure that court orders are implemented and ( Missing word) The Supreme Court was also asked to deputize the National Bureau of Investigation to effect the arrest of Lastimoso and Colayco, and to deputize General Joselin Nazareno and the Armed Forces of the Philippines to implement the TRO in case Lastimoso fails to do so. SUPREME COURT ASKED : ORDER THE ARREST OF LASTIMOSO The Supreme Court was asked today to order the arrest and detention of PNP Director General Roberto Lastimoso and Clark Development Corporation's Rufo Colayco as they continued to defy the Temporary Restraining order which the SC issued almost two (2) weeks ago. The Supreme Court was also asked to deputize the National Bureau of Investigation to carry out the arrest and detention of Lastimoso and Colayco, and to deputize General Joselin Nazareno and the Armed Forces of the Philippines to implement the TRO in case Lastimoso fails to do so. On March 29, the Supreme Court also ordered Lastimoso to implement the TRO. But instead of complying, the PNP deployed Special Fiction Forces from Rizal province at Clark in a bid to reinforce PNP units at the Mimosa Leisure Estate. According to MLRC Legal Counsel Ernesto B. Francisco, Jr., the arrest and detention of Lastimoso and Colayco is allowed under the Rules of Court precisely to ensure that court orders are implemented and followed. Francisco has earlier asked the Supreme Court to cite in contempt Lastimoso, Colayco and Regional Director Roberto Calinisan and other PNP officials. On March 29, Calinisan was ordered by the Court to show cause within a non-extendible period of three (3) days why he should not be cited in contempt for saying that he would not move out his men until the Supreme Court issues a final decision. If found in contempt, these official face a maximum six (6) months imprisonment.
