Guidelines in the Adoption of Cargo Handling Tariffs in PPA Ports

July 28, 2016 PPA OPERATIONS MEMORANDUM ORDER NO. 01-16 TO : All Port Managers Cargo Handling Operators Others Concerned SUBJECT : Guidelines in the Adoption of Cargo Handling Tariffs in PPA Ports 1. Authority Section 6-a (ix) of P.D. 857, Revised Charter of the Philippine Ports Authority, as amended. HTcADC 2. Objective To ensure transparency and uniform implementation in the adoption of cargo handling (CH) tariff in PPA ports. 3. Scope and Application These guidelines in the adoption of CH tariff shall apply to all PPA ports in the following instances : 3.1 For ports with authorized CH Operators and prescribed rates but some tariff items are not existing; 3.2 For ports where CH services are subject for bidding and where there is no prescribed or authorized CH tariff schedule 4. Guidelines 4.1 The adoption of CH rates from the nearest similarly situated government ports shall be anchored on the following parameters: 4.1.1 The initiating port should be similarly situated as that of nearest government port to which the tariff is to be adopted, in terms of the following: 4.1.1.1 Cargo, shipping and passenger statistics; 4.1.1.2 Manner of handling cargoes (operating systems); and, 4.1.1.3 Cargo handling equipment used. 4.1.2 The port requesting to adopt the tariff should be under the same port classification with the port to which the tariff is to be adopted. CAIHTE III. n Procedures The following procedures are hereby reiterated in the adoption of CH tariff: A. For Ports with Authorized CH Operators and Prescribed Rates but Some Tariff Items are not Existing : Service Provider : Submits request for adoption of CH tariff to include justification to the Port Management Office (PMO). PMO: Evaluates the request. Presents the proposal in a public hearing to be attended by stakeholders, representatives from both government and private sectors and other port users concerned. Submits the results of public hearing to include the minutes of the public hearing, attendance sheet and recommendation to the Office of the AGM for Operations (OAGMO), Attention: CSD. CSD/OAGMO: Reviews the proposal. Forwards the recommendation to the Office General Manager (OGM) for approval. OGM: Approves/disapproves the proposal. CSD/DAGMO: If approved by the General Manager (GM), forwards the approval to the PMO for publication in a local newspaper to be effective 15 days after publication. If disapproved by the GM, informs the PMO of the disapproval. PMO: Furnishes CSD/AGMO of the published CH rate. Submits new proposal, if any, should the earlier proposed rates are disapproved. CSD/OAGMO: Validates the published CH rates and forwards to PMO the final CH tariff. aScITE B. For Ports where CH Services are Subject for Bidding and where there is No Prescribed or Authorized CH Tariff Schedule PMO: Submits the request for adoption of CH tariff to include justification and recommendation based on the parameters to OAGMO, Attention: CSD. CSD: Reviews the proposal; Forwards the recommendation to the OAGMO; OAGMO: Approves/disapproves the proposal CSD: If approved by the AGMO, forwards the approval to the PMO for presentation in a public hearing. If disapproved by the AGMO, CSD to submit new recommendation for the AGMO's approval. PMO: Presents the proposal in a public hearing to be attended by stakeholders, representatives from both government and private sectors and other port users concerned. Submits the results of public hearing to include the minutes, attendance sheet and recommendation to the Office of the AGM for Operations, Attention: CSD. CSD/OAGMO: Reviews the results of the public hearing. Forwards the recommendation to the Office General Manager (OGM) for approval. OGM: Approves/disapproves the proposal CSD/OAGMO: If approved by the GM, forwards the approval to the PMO for publication in a local newspaper to be effective 15 days after publication.
