December 7, 2004 PASIG CITY ORDINANCE NO. 43-04 AN ORDINANCE AMENDING ORDINANCE NO. 25, SERIES OF 1992, OTHERWISE KNOWN AS THE PASIG REVENUE CODE Authored by: Councilors Robert C. Eusebio, Jose S. Section 64 of Article I is amended to read as follows: Section 64. Imposition of Fees As a pre-requisite for the use of instrument of weights and measures, every person within Pasig using such instruments in his business, profession or calling shall have them sealed and licensed annually and pay therefor to the City Treasurer the following fees: (a) For sealing linear metric measures Not over one (1) meter P 60.00 Measure over one (1) meter 90.00 (b) For sealing metric of capacity Not over ten (10) liters 60.00 Over ten (10) liters 90.00 (c) For sealing metric instruments of weights 90.00 With capacity of not more than 30 kgs. With capacity of more than 30 kgs. 120.00 but not more than 300 kgs. With capacity of more than 300 kgs. but not more than 3,000 kgs. 150.00 With capacity of more than 3,000 kgs. 180.00 (d) For sealing apothecary balance or other balances of precision Over 3,000 kg. 240.00 Over 300 to 3,000 kg. 180.00 Over 30 to 300 kg. 120.00 30 kgs. or less 60.00 (e) For sealing scale or balance with complete set of weights For each scale or balance with complete set of weights for use therewith 50.00 For each extra weights 30.00 For each and every retesting and resealing of weights and measures instruments including gasoline pumps outside the office upon the request of the owner or operator, an additional service charge of P60.00 for each instrument shall be collected. SECTION 2. Section 69 is amended to read as follows: Section 69. Administrative Penalties Any person found to be guilty of committing any of the above-stated fraudulent practices shall be punished by a fine of not less than Six Hundred (P600.0) pesos not more than Five Thousand (P5,000.00) pesos or by imprisonment of not less than one (1) month nor more than six (6) months or both at the discretion of the court. The Business Permit and License Officer, however, may compromise the following of omission which does not involve fraud before a case is filed in court. (a) Any person making a practice of butting or selling by weight and measure using unsealed and/or unregistered instrument: 1. When weight or measure is correct 600.00 2. When the weight or measure is incorrect but within a tolerable allowance of defect or short measure 900.00 (b) Failure to produce weight and measure tag or license certificate upon demand but the instrument is duly registered: 1. When weight or measure is correct 150.00 2. When the weight or measure is incorrect but within a tolerable allowance of defect or short measure 600.00 Any person found violating any of the provisions under this Article for the second time shall be fined twice the amount of the prescribed penalties. SECTION 3. Section 79 is amended to be read as follows: Section 79. Duplicate License The Office of the Mayor through the Business Permit and License Office shall upon presentation of satisfactory proof that the original copy of the license certificate has been lost, stolen, destroyed or replaces, issue a duplicate of the permit certificate upon payment of fifty pesos (P50.00) for each duplicate issued. Amendment on any data in the business permit registration, including change in address/location, change in ownership, amendment of business name, merger and consolidation shall be approved upon payment of a fee in the amount of One Thousand Pesos (P1,000.00) subject to subsequent inspection and recommendation by the Business Permit and License Office and examination of books of accounts by the City Treasurer's Office. Section 87 is amended to read as follows: Section 87. Time of payment The Mayor's Permit Fee on occupation or calling shall be paid to the City Treasurer before any occupation or calling can be pursued in the City. In the ensuing year, payment of the annual permit fee in the amount of Forty Pesos (P40.00) shall be within the first twenty (20) days of January. SECTION 6. Section 88 is amended to read as follows: Section 88. Rate of Permit Fee There shall be collected the amount of Forty Pesos (P40.00) from any person who shall exercise his occupation or calling within the City. SECTION 7. Section 148 is amended to read as follows: Section 148. Section 153 is amended to read as follows: Section 153. Section 157 is amended to read as follows: Section 157. Imposition of Fees Cost of the number plates including installation shall not exceed ninety pesos (P90.00). Payment of fees to the City Treasurer shall be before installation of plates. SECTION 11. Section 158 is amended to read as follows: Section 158. Imposition of Fees Every person who has animals or fowls slaughtered in any slaughterhouse in the City shall pay the following permits fees: Large cattle, per head 30.00 Hogs, per head 15.00 Goats, sheeps and the like, per head 15.00 Fowls, per head 0.30 SECTION 12. Section 162 is amended to read as follows: Section 162. Section 171 is amended to read as follows: Section 171. Imposition of Fees Every person or entity who shall establish, operate, and maintain gun clubs within the City of Pasig shall first secure a license from the City Mayor through the Department of Public Order and Safety and pay the corresponding fee: aAcDSC 1 5 firing ranges 3,000.00 6 10 firing ranges 6,000.00 more than 10 ranges 30,000.00 SECTION 15. Section 174 is amended to read as follows: Section 174. TDSICH The business permit registration plate shall be renewed through a printed sticker bearing the current and quarter period and shall be provided free of charges as proof of payment of taxes, fees and charges for the current year. Business registration plates shall be replaced every three (3) years through an appropriate ordinance authorizing the same. The business permit registration plate shall be permanently displayed in a conspicuous portion of the establishment that is visible to the public view. Any violation of this provision shall be punishable by a fine of not exceeding One Thousand Pesos (P1,000.00). SECTION 38. Effectivity.
