September 25, 2012 Excerpts from the Journal of the Regular Session of the Sangguniang Panlalawigan of Pampanga Held on September 25, 2012 at the Session Hall, Capitol Building City of San Fernando, Pampanga PAMPANGA PROVINCIAL ORDINANCE NO. 562-12 AN ORDINANCE ENJOINING ALL MUNICIPALITIES IN THE PROVINCE OF PAMPANGA TO USE, IMPLEMENT AND INSTALL THE REAL PROPERTY TAX ADMINISTRATION SYSTEM (RPTAS), TO PROVIDE COPIES OF REAL PROPERTY TAX RECORDS AND FOR OTHER PURPOSES Sponsors: All Members WHEREAS, Sec. 17 (3) (x) of the Local Government Code of 1991 provides that the provincial government may upgrade and modernize tax information and collection services through the use of computer hardware and software and other means; WHEREAS, Section 200 of the Local Government Code states that the Province shall be primarily responsible for the proper, efficient and effective administration of the real property tax; HTcADC WHEREAS, the Province aims to establish an accurate spatial data in the Province due to a decade of continuously changing topographical configuration brought about by the eruption of Mt. Pinatubo and the fast paced economic growth of its municipalities; WHEREAS, the Province aims to establish an accurate Geographical Information System (GIS) based mapping system in order to provide efficient delivery of services to its constituents; WHEREAS, the Province aims to enhance its operations, specifically its major revenue generating systems, socio-economic profile systems, administrative systems and services linked to the GIS-based mapping system to ensure effective and efficient collection of taxes and fees, and to institute transparency in administrative affairs and resource management as well as to improve business transactions within the local government unit through the process of automation/computerization; WHEREAS, the Province in line with this is also in the process of installing an integrated Real Property Tax Administration System (RPTAS) to meet the requirements of every municipality in the Province pertaining to real property tax recording and tax collection activities; NOW THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG PANLALAWIGAN OF THE PROVINCE OF PAMPANGA, in regular session assembled, that: SECTION 1. This Ordinance shall be known as "An Ordinance enjoining all municipalities in the Province of Pampanga to use, implement and install the Real Property Tax Administration System (RPTAS), to provide copies of Real Property Tax Records and for other purposes." SECTION 2. Under the ordinance, all the municipalities within the Province of Pampanga shall be enjoined to use, implement and install the Real Property Tax Administration System (RPTAS) in all matters of real property application, use, description, administration and taxation. SECTION 3. The Province of Pampanga shall provide all municipalities with the RPTAS application software free of charge. The infrastructure and hardware component of the system, however, shall be for the account of the municipality concerned. Further, the municipalities shall include in their annual budget appropriation an annual maintenance fee for the use of the system in the amount as follows: Name of the Module Base Fee Additional Fee RPT for Municipalities (If under a province) Php15,000.00 Class 1: Php20,000.00 Class 2: Php15,000.00 Class 3: Php10,000.00 Class 4: Php5,000.00 Class 5 and Class 6: None SECTION 4. All Municipalities, through the Municipal Treasurers, shall provide copies of all their Real Property Tax Account Registers for synchronization with the Real Property Tax Records of the Province; failing in which may subject the said official to administrative sanction. SECTION 5. The implementation of software turn-over, the undertaking of a refresher's course for the input of municipal data and the deadline the municipalities must meet in relation to the synchronization of data which shall be elaborately stated in implementing guidelines to be released by the Province. SECTION 6. In case conflicts arise between the RPTAS and the computerized real property system of municipalities who have started their own computerization project, the RPTAS shall prevail as far as data and information necessary to the implementation of the real property tax. Should the dispute persist, the matter may be elevated to the Department of Finance, through the Bureau of Local Government Finance for resolution. SECTION 7. Certified copies of this ordinance shall be furnished all agencies/offices concerned for their information and strict compliance. APPROVED.
