Ignacio St., Camilmil, City of Calapan, Oriental Mindoro, on Monday, September 1, 2014 ORIENTAL MINDORO PROVINCIAL ORDINANCE NO. 039-14 ORDINANCE AMENDING PROVINCIAL ORDINANCE NO. 021-2011 OTHERWISE KNOWN AS THE REVISED REVENUE CODE OF ORIENTAL MINDORO BY INSERTING ARTICLE F UNDER CHAPTER IV THEREOF PROVIDING FOR THE IMPOSITION OF FEES FOR THE SERVICES RENDERED BY THE PROVINCIAL GOVERNMENT-ENVIRONMENT AND NATURAL RESOURCES OFFICE (PG-ENRO) WHEREAS, on 29 September 2011, Provincial Ordinance No. 021-2011 otherwise known as the Revised Revenue Code of Oriental Mindoro (2011) was enacted by the Sangguniang Panlalawigan and was duly approved by the Honorable Provincial Governor Alfonso V. Umali, Jr. on 22 December 2011; WHEREAS, the Provincial Government-Environment and Natural Resources Office rendered services through its operation and maintenance of Provincial Nursery that offers forestry tree species to private individuals or organizations with corresponding amount per seedling; WHEREAS, at present, per Provincial Ordinance No. 03-2005, the PG-ENRO caters planting materials at the amount of P2.00/seedling that is not sufficient to the cost incurred in the cultivation of the same, such as plastic bags, garden soil, fertilizer and chicken manure, as well as the labor cost; WHEREAS, notably, Provincial Ordinance No. 03-2005 was superseded by the enactment and approval of Provincial Ordinance No. 021-2011 or the Revised Revenue Code of Oriental Mindoro (2011); however, the price of planting materials being sold by the PG-ENRO was not included in the said Code; WHEREAS, based on the above premises, amending the Revised Revenue Code of Oriental Mindoro (2011) is therefore necessary; NOW THEREFORE, BE IT ORDAINED, as it is hereby ordained by the Sangguniang Panlalawigan of Oriental Mindoro that: SECTION I. Title . This ordinance shall be entitled "Ordinance amending Provincial Ordinance No. 021-2011 otherwise known as the Revised Revenue Code of Oriental Mindoro by inserting Article F under Chapter IV thereof providing for the imposition of fees for the services rendered by the Provincial Government-Environment and Natural Resources Office (PG-ENRO)." SECTION II. Amendatory Clause . Chapter IV of the Provincial Ordinance No. 021-2011 otherwise known as the Revised Revenue Code of Oriental Mindoro (2011) is hereby amended to insert Article F thereof, to wit: ARTICLE F. PROVINCIAL GOVERNMENT-ENVIRONMENT AND NATURAL RESOURCES OFFICE SERVICE FEES. Section 197. Imposition of Fees . (a) The following schedule of fees is hereby imposed for services rendered by the PG-ENRO: 1. Charge for the services availed at the Provincial ENRO Nursery Reference Price of Planting Materials Other Planting Materials a. Forest Trees Narra P4.00 Mahogany P4.00 Gmelina P4.00 Fire Tree P4.00 All indigenous species prevailing to the province P15.00 b. Bamboo sprout All bamboo species P20.00 Section 198. Time and Manner of Payment. The fees imposed in the preceding Section shall be paid to the Provincial Treasurer or his deputy. Official receipt shall be presented to the personnel in-charge of the Provincial Nursery before acquiring planting materials bought therein. All the succeeding Sections affected by the insertion of the above new Sections are hereby amended accordingly. SECTION III. Effectivity Clause.
