June 15, 2020 Excerpt from the Journal of the 44th Regular Session of the 10th Sangguniang Panlalawigan of Nueva Vizcaya held at the Session Hall, People's Hall, Capitol Compound, Bayombong, Nueva Vizcaya, on June 15, 2020, from 9:01 a.m. to 12:16 p.m. NUEVA VIZCAYA PROVINCIAL TAX ORDINANCE NO. 017-20 AN ORDINANCE AMENDING TAX ORDINANCE NO. 2016-008 OTHERWISE KNOWN AS AN ORDINANCE AMENDING CHAPTER IV, PERMIT AND SERVICES FEES OF THE REVENUE CODE OF THE PROVINCE OF NUEVA VIZCAYA, TO INCLUDE IN CHAPTER IV, ARTICLE TWO, SECTION 2, PERIODS OF DECLARED STATE OF CALAMITY OR PUBLIC HEALTH EMERGENCY BE IT ENACTED BY THE SANGGUNIANG PANLALAWIGAN OF THE PROVINCE OF NUEVA VIZCAYA IN SESSION ASSEMBLED THAT: SECTION 1. The following provision shall be included as a new provision in the existing Chapter IV, Permit and Services Fees, Article Two of Tax Ordinance No. 2016-008. SECTION 2. PERIODS OF DECLARED STATE OF CALAMITY OR PUBLIC HEALTH EMERGENCY. The Certifications issued by all Provincial Offices in favor of Provincial Government Employees, regardless of employment status, for the purposes of claiming benefits, loans or financial assistance, shall be exempted from the collection of certification fees during a period of proclaimed National or Local State of Calamity or State of Emergency. The benefit provided under this Section shall remain effective for the period of sixty (60) days from the declaration of National/Local State of Calamity, State of Public Health Emergency or until such proclamations are lifted by competent national/local authorities. For the purpose of this Section, the following shall mean: (a) Calamity shall be defined as a state of extreme distress or misfortune, produced by some adverse circumstance or event or any great misfortune or cause or loss or misery caused by natural forces. (b) Emergency shall mean circumstances arising from a typhoon, earthquake, or any other calamity. SECTION 2. Separability Clause. If for any reason or reasons, any part or provision of this ordinance is declared unconstitutional or invalid, other parts or provisions thereof which are not invalidated shall continue to be in force and with full effect. SECTION 3. Repealing Clause. This Ordinance shall be subject to amendment, alteration or repeal by any future guidelines to be issued by a competent authority. SECTION 4. Effectivity Clause. This Ordinance shall take effect immediately after the 3rd day of its complete posting on the Bulletin Boards of the provincial and other government offices in the province. CARRIED. Sponsor: Hon.
