December 12, 2002 NAVOTAS MUNICIPAL ORDINANCE NO. 025-02 AN ORDINANCE AMENDING CHAPTER 23 OF PAMBAYANG ORDINANSA BLG. 92-12, ALSO KNOWN AS NAVOTAS REVENUE CODE OF 1992, THE GARBAGE SERVICE CHARGES WHEREAS, the cost of supervising and regulating the day to day operations of businesses and private individuals has been spiraling and has increased in the last nine (9) years; WHEREAS, there is a substantial increase in the operational cost of garbage management and disposal since 1992, and the municipality has to spend thirty million pesos a year just for this purpose; WHEREAS, under the Local Government Code, each local government unit shall exercise its power to create its own sources of revenue and to levy fees and charges commensurate with the cost of regulation, inspection and licensing and/or services rendered; WHEREAS, the need for increase of garbage service charges is necessary to meet the expenses being incurred by the municipality regarding garbage disposal and not to hamper the delivery of basic services to the public; NOW, THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED by the Sangguniang Bayan of Navotas, in session assembled, as follows: EHCDSI SECTION 1. Chapter 23, Section 115, Garbage Service Charges, of Pambayang Ordinansa Blg. 92-12, known as the Revenue Code of the Municipality of Navotas, Metro Manila, is hereby amended as follows: Section 115 RATE OF CHARGES except as otherwise provide herein, garbage service charges shall be collected quarterly from every person (natural or juridical) engaged in business, occupation or calling or any undertaking in the municipality in accordance with the following schedule: Rate Per Quarter Old New SCHEDULE A AIRCRAFT AND WATER COMPANIES 1.) Businesses stated in Schedule S that generates more than 3 cu. m. of garbage weekly will be charged base on the following: cTSDAH 1. In excess of 3 cu. m. of weekly generated garbage, additional charges of P100.00 per cu. m. will be collected; 2. Or may avail the special garbage collection per truck according to the following schedule: P1,500.00 for ten wheeler dump truck (w/cargo capacity of 15 cu. m.) P700.00 for mini dump truck (w/cargo capacity of 7 cu. m.) C. Businesses that have their own garbage hauling service will pay their garbage fee according to the aggregate area of their business establishments. SECTION 2. For purposes of this Ordinance, the following terms are hereby defined as follows: a.) Private individuals shall refer to any persons who have established domicile in the Municipality of Navotas. b.) Entities shall refer to industrial factories, manufacturing plants, business and commercial establishments, and the like that operate within the Municipality of Navotas. c.) Special Garbage Collection Services shall refer to the collection of garbage or wastes for a fee, in compliance to requests from private individuals or entities requiring special trips by the municipal garbage trucks. d.) Special Trips shall refer to the extra travel of ESO garbage trucks to and from garbage collection point to the dumpsite, outside of its designated schedule. e.) Mini-Dump Truck shall refer to the 6-wheeler garbage truck with a cargo capacity of 7 cubic meters. f.) Ten-Wheeler Dump Truck shall refer to the 10-wheeled garbage truck with a cargo capacity of 15 cubic meters. SECTION 3. Garbage Service Charges for Multiple Business . Where there are too more kinds of businesses subject to the garbage charges, conducted on the same place or establishment by the same owner or operator, the charge to be collected shall be that which has the highest rate among the businesses concerned plus twenty five (25%) percent thereof, provided that the total garbage fee shall not exceed Nine Thousand (P9,000.00) Pesos per annum. SECTION 4. For reasons beyond control (i.e. increase in the cost of maintenance, lack of serviceable trucks, absence of disposal site within the municipality), this municipality reserved its right to decline requests for collection of garbage from business entities, private individuals. SECTION 5. Business entities/private individuals having their own garbage hauling service or having their own hauling service contractor will be allowed to dump their garbage until the disposal facility of this municipality is available. In this case, garbage fees will be based on aggregate area only. SECTION 6. Manufacturers/Producers Maintaining or Operation Principal Offices, Factories and/or Sales Offices in the same Premises . for purposes of collection of the garbage charges under Schedule S (I), manufacturers or producers maintaining their factory, principal or sales offices in the same premises shall pay the garbage charges based on the total aggregate area of such business premises at rates prescribed under Schedule S (I-A) of this Chapter. ITDHcA SECTION 7. Newly Established Business . In the case of a newly established business, the applicable garbage charges shall be computed proportionately to the quarterly charge. SECTION 8. The Internal Rules and Regulations for Special Garbage Collection Services are as follows: A. All request for special garbage collection services shall be made in writing and submitted to the Office of the Mayor. B. Upon approval of the Mayor's Office, the Business Permits and Licensing Office will be the one to issue the order of payment. C. Payment shall be made only to the Municipal Treasurer or his duly authorized collection agent upon presentation of the order of payment and will be issued corresponding official receipt. (Note: The said official receipt or a photocopy thereof must be presented by each establishment as proof of payment for the services previously rendered otherwise, its waste shall not be collected.) D. After the payment has been made at the Treasurer's Office, the official receipt will be presented to the BPLO for the release of trash bags and trip tickets. Trip tickets shall bear the date and time of collection of garbage. (Note: Each trash bags corresponds to a specific volume and amount in cu. m.) E. Only municipal dump-trucks and crew under the Environmental Sanitation Office (ESO) shall be authorized to collect garbage at commercial and industrial establishment. F. Each assigned dump-trucks and crew will be issued serialized trip tickets which will be presented to authorized personnel of commercial and industrial establishment for acknowledgement and to the municipal volume checker/inspector for validation. Each ticket must contain the driver's and crew members' names and signatures, control no., truck body and plate no., volume as basis for payment computation and the names and signatures of the owner or authorized representative and municipal volume checker/inspector. G. Specifically designed garbage trash bags shall be issued by the Municipal Government to commercial and industrial establishments to be able for them to segregate their waste (bio-degradable or non-biodegradable) each bearing the Official Seal of the Municipal Government with the standard volume or weight indicated thereon. H. There will be specified time for collection of commercial and industrial waste. Untimely placing of garbage outside the business premises is prohibited. I. Collection to these establishments will be scheduled during the week with each type of waste, bio-degradable or non-biodegradable. Waste must be segregated at source, deodorized and sanitized especially biodegradable waste and must be placed in sealed trash bags for safe handling and collection. J. Using of trash bags other than the specifically designed trash bags issued by this municipality is prohibited. SECTION 9. Penalty Clause (Special Garbage Collection) . a.) Any business establishments/private individuals caught illegally dumping their garbage in areas not designated as collection point shall be penalized under the Municipal Ordinance No. 2001-11. b.) Any establishment/private individual caught of placing their garbage beyond the specified time of collection shall be penalized with a fine of Five Hundred Pesos (P500.00). c.) Using of trash bags other than the specifically designed trash bags issued by this Municipality shall be penalized with a fine of One Thousand Pesos (P1000.00). d.) ESO Personnel caught of collecting garbage in trash bags other than the official garbage bags will be terminated from office. e.) Municipal Personnel caught of collecting garbage without the official trip ticket will be terminated from office. SECTION 10. Any provisions of the Revenue Code of the Municipality of Navotas, Metro Manila, Pambayang Ordinansa Blg. 92-12 that are inconsistent with this ordinance are hereby repealed or amended accordingly.
