1994 NAVOTAS MUNICIPAL ORDINANCE NO. 009-94 AN ORDINANCE AMENDING CHAPTER 29, SECTION 142 OF THE REVENUE CODE OF NAVOTAS; ELIMINATING THE CHARGING OF FEES ON REGISTRATION OF LIVE BIRTHS, MARRIAGES, DEATHS AND FOUNDLINGS; IN THE OFFICE OF THE LOCAL CIVIL REGISTRAR OF NAVOTAS, MANDATING THE OBLIGATION TO REGISTER THESE CIVIL STATUS, PROVIDING FOR PENALTIES FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES WHEREAS, Chapter 49, Section 142 of the Revenue Code of Navotas provides for charging of fees for the registration of LIVE BIRTH, MARRIAGES, DEATHS AND FOUNDLINGS, and other circumstances pertaining to civil status; WHEREAS, according to Section 142, of the Local Government Code, local government units are empowered to grant tax exemption privileges in any form of services rendered to the public in accordance with approved ordinance for the purpose, under certain conditions; WHEREAS, the granting of exemption from paying fees for the above-mentioned cases of registration shall be greatly beneficial to the people, especially to those who are poor who cannot afford to pay such fees for registration; WHEREAS, Presidential Proclamation No. 326, Series of 1994 as amended by Proclamation No. 437, enjoins all local executives to cause the immediate repeal, amendment or modification of exacting ordinances and or resolutions exacting civil registration fees; DTAESI WHEREAS, the same proclamation declares that the registration of births, deaths, marriages and foundlings is a state policy; NOW, THEREFORE, the Sangguniang Bayan, in session assembled, hereby enacts this ordinance. SECTION 1. Henceforth, the registration of LIVE BIRTHS, MARRIAGES, DEATHS AND FOUNDLINGS, shall be exempted from payment of registration fees, including acknowledgment, paternity filiation, legitimation, delayed registration of births, deaths and marriages. SECTION 2. Chapter 29, Section 142 of the Municipal Revenue Code of Navotas, is hereby amended, to read as follows: b) Filing and Registration Fees For: 1. Election of Philippine Citizenship P200.00 2. Decree of Adoption 50.00 3. Decree of Foreign Adoption 150.00 4. Naturalization 500.00 5. Legal Separation 150.00 6. Divorce 150.00 7. Annulment of Marriages 200.00 8. Emancipation of Minors 50.00 9. Judicial Recognition 30.00 10. Guardianship 50.00 11. Aliases 150.00 12. Repatriation 150.00 13. Judicial Order for Correction of Entry 100.00 SECTION 3. It shall be duty of the owner or head of any hospital or clinic within the municipality of Navotas whether public or private, to cause the registration of Live Birth in the office of Local Civil Registrar of Navotas, within a period not later than THIRTY (30) DAYS from the date of delivery. SECTION 4. It shall likewise be the duty of any doctor, whether public or private practitioner, or any midwife, HILOT or any person who directly caused or attended the delivery of live birth of any infant in the house of the mother, or in any place other than a clinic or hospital, within the municipality of Navotas to register or report such birth within the period not later than THIRTY (30) DAYS. In case of refusal on the part of the parent or parents to sign the birth certificate for registration by the person attending the delivery, it shall be the duty and responsibility of the parents who refused to sign the birth certificate to register such birth within the period not later than THIRTY (30) DAYS. SECTION 5. It shall be the duty of any person who solemnized the marriage of any spouses within the jurisdiction of Navotas, whether by a Judge, Mayor, Priest, Pastor, or Minister of any religious denomination authorized to solemnize marriage, or such person solemnizing marriage of exceptional character, to cause the registration of such marriage within the period not later than THIRTY (30) DAYS, after the performance of the marriage. In the case of a marriage solemnized in ARTICULO MORTIS, which was performed in a place where there is no means of transportation, specifying the barangay thereof, the marriage certificate shall be submitted to the Local Civil Registrar or Registration within a period of not later than THIRTY (30) DAYS, after the performance of the marriage (Art. 29 Family Code). SECTION 6. It shall be the duty of the parents, surviving spouses, the most senior son or daughter, or member of the household of the deceased person to report to the office of the Municipal Health Officer of Navotas the death of such person before the burial of the same, in the above order. SECTION 7. The Municipal Health Officer of Navotas shall cause the registration of such death within the period of not later than THIRTY (30) DAYS, upon receipt of the report. SECTION 8. It shall be the duty of any person who shall have found an ABANDONED person, child or infant, within the Municipality of Navotas to register such person in the office of the Local Civil Registrar within the period of THIRTY (30) DAYS, upon having found such person. SECTION 9. In case of failure on the part of the Judge, Mayor, Doctors and their assistants, in their official capacity to comply with the provisions of sections 3, 4, 5, 6, 7 and 8 of this ordinance they shall be held liable under pertinent existing Laws. SECTION 10. Definition of Terms . 1. Live Birth An infant born alive from the womb of the mother, or a fetus with intra-uterine life less than 7 months and having lived for a period of 24 hours after delivery. 2. Marriage The legal and official pronouncement that a man and a woman are duly married spouses, solemnized in a civil or religious rite. 3. Death The cessation of life in a person, as clinically and officially declared by a person competent to determine such state of a body. 4. Foundling Any person, child or infant, below 16 years of age, found ABANDONED or left without care custody (to fate), by the parent or parents or guardian. 5. Private Person A person not employed in the government, neither in the national nor local office. SECTION 11. Penalties . Any private person found guilty of violating any of the provisions of Sections 3, 4, 5, 6, 7 and 8 of this ordinance shall be punished by a penalty of TEN (10) DAYS imprisonment or a fine of not more than FIVE HUNDRED (P500.00) PESOS, or both, in the discretion of the Court. SECTION 12. Repealing Clause . Any Ordinance which is inconsistent with the provisions of this Ordinance is hereby repealed, amended or modified accordingly.
