Amendment to Section 75 (c) of the Navotas Revenue Code, as amended

March 3, 1994 NAVOTAS MUNICIPAL ORDINANCE NO. 004-94 AN ORDINANCE AMENDING SECTION 75 PARAGRAPH C OF MUNICIPAL ORDINANCE NUMBERED 92-12, OTHERWISE KNOWN AS NAVOTAS REVENUE CODE AS AMENDED AND FOR OTHER PURPOSES WHEREAS, Navotas, Metro Manila, is a fishing center where the largest fish port in ASIA is located, and as such fishing is one of its prime and traditional industries; WHEREAS, the fishing industry provides employment opportunities to the people of Navotas; WHEREAS, there is a need to enhance the economic viability of the fishing industry; WHEREAS, one of the basic principles of a sound tax system is theoretical justice and that in order to give meaning and substance to the said principle, there is a need to amend and modify certain portion of Municipal Ordinance No. 92-12 as amended otherwise known as Navotas Revenue Code; NOW, THEREFORE, the Sangguniang Bayan of Navotas in session assembled, hereby enacts this ordinance. SECTION 1. SECTION 75, paragraph C of Chapter 12 of Municipal Ordinance No. 92-12 otherwise known as Navotas Revenue Code is hereby amended, to be read as follows: "On Exporters, and or manufacturers, millers, producers, wholesalers, distributors, dealers, or retailers of essential commodities enumerated hereunder at a rate of one-half (1/2) of the rates prescribed in Paragraph (a), (b), and (d) of this section. Provided however that for the purpose of implementing this provision, fishing boat operators with gross tonnage of 3 tons or more shall be considered producers. Provided finally that fishing boat operators herein referred to shall be subject to the rate of one-fourth (1/4) of the rates prescribed in Paragraph (a), (b) and (d) of this section. SECTION 2. Tax Credit . Graduated business tax paid under the old rate for 1994 which is in excess of the rate herein provided shall be credited for next succeeding quarter or succeeding calendar year, whichever is deemed applicable. SECTION 3. Effectivity Clause . This ordinance shall take effect after 10 days upon approval from the date a copy hereof is posted in a bulletin board at the entrance of the Municipal Hall and in other two conspicuous places in the municipality. SECTION 4. Separability Clause . If any portion of this ordinance is declared ultra-vires or unconstitutional by a court of competent jurisdiction, the remainder which is not affected thereby shall remain valid, binding and effective. ANGELES Vice Mayor PAMBAYANG ORDINANSA BLG. 004-94 ORDINANSA NA NAG-AAMYENDA SA SEKSYON 75 PARAPO (C) NG PAMBAYANG ORDINANSA BLG. 92-12, LALONG KILALA NA KODIGO NG PAGKAKAKITAAN NG NAVOTAS (NAVOTAS REVENUE CODE) NA INAMYENDAHAN, AT SA IBA PANG PANGANGAILANGAN SAPAGKAT, ang bayan ng Navotas, Kalakhang Maynila ay kinikilalang sentro ng pangingisda at narito ang pinakamalaking punduhan (port) ng isda sa buong ASIA, at, pangingisda ang isa sa pangunahin at kaugaliang industriya at nagbibigay-hanapbuhay sa maraming mamamayan ng Navotas; SAPAGKAT, nangangailangan na pag-ibayuhin at pasiglahin ang ekonomiya ng industriya ng pangingisda; SAPAGKAT, isa sa mga pangunahing pamantayan ng makabuluhang paraan ng buwisan (tax system) ay ang pagiging makatarungan nito at, tungo sa pagbibigay ganap na kahulugan at diwa sa binanggit na pamantayan ay kailangan na amyendahan at isaayos ang ilang bahagi ng Pambayang Ordinansa Blg. 92-12 o KODIGO NG PAGKAKAKITAAN NG NAVOTAS (Navotas Revenue Code); DAHIL DITO, PAGTIBAYIN na tulad ngayon ay PINAGTIBAY NG SANGGUNIANG BAYAN ng Navotas, Kalakhang Maynila ang Ordinansang ito na binubuo ng mga sumusunod: SEKSYON 1. Inaamyendahan ang Seksyon 75, parapo 'c' Kabanata 12 ng Pambayang Ordinansa Blg. 92-12, KODIGO NG PAGKAKAKITAAN NG NAVOTAS, gaya ng: (C) Sa mga nagluluwas sa labas ng bansa (exporter); at/o mga may mga pagawaan (manufacturers); may mga kiskisan (millers); gumagawa ng iba't-ibang produkto (producers); nagbibili ng pakyawan (wholesalers); taga-pamahagi (distributors); nagbibili o nagtitingi (dealers or retailers) ng mga pangunahing pangangailangan (essential commodities) na binabanggit sa ilalim nito, sa antas na kalahati (1/2) ng antas na itinatakda sa parapo (a), (b), at (d) ng Seksyong ito. Itinatagubilin, na para sa pagpapatupad ng alituntunin ito, ang mga 'operator' ng bangkang pamalakaya na may kabuuang timbang (gross tonnage) na 3 tonelada pataas ay ituturing na mga 'producers'. Itinatagubilin sa huli, na ang mga 'operator' ng bangkang pamalakaya na tinukoy dito ay papasailalim ng antas na IKA-APAT (1/4) sa antas na itinakda sa mga parapo (a), (b) at (d) ng Seksyong ito. SEKSYON 2. Kredito sa Buwis (Tax Credit). Ang baha-bahagdang Buwis sa Negosyo (graduated Business Tax) na binayaran sa ilalim ng dating antas ng halaga para sa taong 1994 na labis sa ngayon ay itinatakda ng Ordinansang ito ay ibibilang na kredito sa nagbayad para sa susunod na pang-ika-apat na bahagi ng taon (quarter) o, sa susunod na taon, kung alinman ang marapat. SEKSYON 3. Pagkakabisa. Ang Ordinansang ito ay magkakabisa sampung (10) araw matapos na mapagtibay at maipaskil sa 'bulletin board' sa may pagpasok ng gusali ng Pamahalaang Bayan at sa dalawa pang hayag na pook sa bayan ng Navotas. SEKSYON 4. Paghihiwalay. Kung may bahagi nito na ipahayag na di sumasang-ayon sa Saligang Batas ng hukumang may sadyang karapatan tungkol dito, ang mga bahaging hindi ipinahayag na gayon ay mananatiling umiiral.
