July 22, 2014 NAGA CITY ORDINANCE NO. 043-14 AN ORDINANCE APPROPRIATING EIGHT MILLION PESOS OF THE INCREMENT FROM ORDINANCE 2013-065 KNOWN AS "AN ORDINANCE AMENDING CHAPTER III AND OTHER PERTINENT PORTIONS OF ORDINANCE NO. 2004-123 ENTITLED "REVENUE CODE OF NAGA CITY" FOR PERPETUATING AND SECURING VITAL CITY GOVERNMENT RECORDS AND FOR UNDERWRITING YET UNFUNDED PROJECTS REQUESTED IN DIFFERENT BARANGAYS" Author: Hon. Esteban Greg R. Abonal III Explanatory Note At its 24th Regular Session on 20 December 2013, the 11th Sangguniang Panlungsod approved Ordinance No. 2013-064, the 2014 Executive Budget. Even as the total appropriation amounted to Seven Hundred Fifty-One Million Pesos, still there were plans, proposals, and requests from the various departments, urgent and important though they may be, that could not be funded by the projected 2014 revenues. aDSIHc At the same Session on the same date, immediately following the approval of Ordinance 2013-064, the Sangguniang Panlungsod likewise approved Ordinance No. 2013-065, amending Ordinance No. 2004-123, otherwise known as the Revenue Code of Naga City. The new ordinance adjusted many non-tax fees and charges, the increment of which is conservatively set by the Local Finance Committee at Eight Million Pesos. This increment was not included as revenue in the 2014 Executive Budget. At the 49th Session last July 1, the Sanggunian approved Ordinance No. 2014-037 reverting One Million, Three Hundred Sixty-Two Thousand Two Hundred Sixty-Five Pesos (P1,362,265,00) from the 10% Mandatory Office Reserves and the 10% Special Purpose Appropriation Reserves for some thirty-three various unfunded projects of the Special Concerns Office of the Solid Waste Management Office. Despite the reversion, the Special Concerns Office still has a list of requests that can no longer be funded by the depleted budget for such purposes this year. Be it, therefore, ordained by the Sangguniang Panlungsod of the City of Naga that: SECTION 1. From the increment derived from the implementation of Ordinance No. 2013-065 in FY 2014, the amount of Four Million Pesos (P4,000,000.00) is hereby appropriated to perpetuate and to secure vital records of City Government offices, especially but not limited to, the offices of the Sangguniang Panlungsod Secretariat, the Treasurer, the Accountant, the Assessor, the Civil Registrar, the Mayor, Planning and Development, Human Resources and Management, Housing Settlements & Development, Auditor. The City Mayor shall designate the Officer-in-Charge of this project and direct him to submit a feasibility study and project proposal for immediate implementation. SECTION 2. From the increment derived from the implementation of Ordinance No. 2013-065 in FY 2014, the amount of Four Million Pesos (P4,000,000.00) is hereby appropriated to underwrite projects of the Special Concerns Office as requested in various barangays: ETHIDa Project and Site Cost Estimate Priority City Projects 1 Construction: Proposed Fish Processing, Brgy. Carolina 262,105 35 Elevation of Terminal Flooring 60,000 Cor. Magsaysay Shell, Brgy. Balatas Provided, That no other may be added to nor may be substituted for any of the aforementioned projects nor funding may be realigned for another without clearance from the City Mayor and the Sanggunian. SECTION 3. Any other amount from the increment derived from the implementation of Ordinance No. 2013-065 in FY 2014 in excess of Eight Million Pesos now appropriated by this ordinance shall accrue further to the account and purpose of the aforementioned appropriations that still need the most, subject to further appropriation ordinance by the Sanggunian. SECTION 4. Any amount from the increment derived from the implementation of Ordinance No. 2013-065 in FY 2014 remaining as savings from any of the funds now appropriated by this ordinance for each of the aforementioned purposes shall accrue further to the account and purpose of the aforementioned appropriations that still need the most, subject to further appropriation ordinance by the Sanggunian. SECTION 5. The increment derived from the implementation of Ordinance No. 2013-065 shall be included in the Statement of Receipts for General Fund beginning FY 2015. cSEDTC SECTION 6.
