April 13, 2009 MUNTINLUPA CITY ORDINANCE NO. 085-09 AN ORDINANCE AMENDING SECTIONS 42 AND 51 OF ORDINANCE NO. 93-35, "ADOPTING A REVENUE CODE OF THE MUNICIPALITY OF MUNTINLUPA" SECTIONS 26, 76 AND 105 OF ORDINANCE NO. 02-076, AND SECTION 87 OF ORDINANCE NO. 02-052 Sponsored by: Hon. Teves SK Chairman WHEREAS, the then Sangguniang Bayan of Muntinlupa passed and approved Ordinance No. 93-35, otherwise known as, "Muntinlupa Revenue Code and no amendments has been made since its passage in 1993; WHEREAS, the Sangguniang Panlungsod of Muntinlupa passed and approved Ordinance No. 02-076, entitled, "an ordinance amending Ordinance No. 93-35, otherwise known as the Revenue Code of Municipality of Muntinlupa and adopting the new rates prescribed under this ordinance"; WHEREAS, the Sangguniang Panlungsod of Muntinlupa also passed and approved Ordinance No. 02-052, entitled, an ordinance amending Section 87 and 88, Article II, Chapter II of Ordinance No. 93-35 adopting a Revenue Code of the Municipality of Muntinlupa; WHEREAS, the rates prescribed under Ordinance No. 03-35 as amended by Ordinance 02-076 and Ordinance No. 02-052 are very much lower compared to the rates prescribed by neighboring cities in Metro Manila; WHEREAS, there has been an increase in the delivery of basic goods and services being offered by the City and there are more migrants from adjacent cities and municipalities who migrated in our city and more improvements and development projects were being implemented by the city; WHEREAS, there is a need to amend and update the prescribed rates in the Muntinlupa Revenue Code to augment the demands of the City's continuing growth and progress; NOW, THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the Members of the 5th Sangguniang Panlungsod duly assembled to amend Ordinance No. 93-35, otherwise known as the Revenue Code of Municipality of Muntinlupa and Ordinance No. 02-076 "an ordinance amending Ordinance No. 93-35, otherwise known as the Revenue Code of Municipality of Muntinlupa and adopting the new rates prescribed under this ordinance" as follows: ITcCaS SECTION 1. This Ordinance amending Sections 42 and 51 of Ordinance No. 93-35, "adopting a Revenue Code of the Municipality of Muntinlupa" Sections 26, 76 and 105 of Ordinance No. 02-076, and Sections 87 of Ordinance No. 02-052: CHAPTER IV. Tax on Transfer of Real Property Ownership of Ordinance No. 93-35 is hereby amended and shall be now read as follows: Section 42. Imposition of Tax. There is hereby imposed a tax on the sale, donation, barter, or any other mode of transferring ownership or title of real property at the rate of seventy five percent (75%) of one (1%) percent of the total consideration involved in the acquisition or the monetary consideration involved in the transfer whichever is higher. CHAPTER VI. Professional Tax SECTION 51(C) Imposition of Tax of Ordinance No. 93-35 is hereby amended and shall be now read as follows: Section 51(c). Chief Mates, Flight Attendants, Commercial Stewards, and stewardesses. Insurance Adjusters, Land Surveyors, Masseurs, Professional Actors and Actresses, Pelotaris, Foresters and geologist, Midwives, Chemists, Associate and Assistant Electrical Engineers, Marine Officers, Therapist, Tattoers, Stage Performers, Chirpodists, Dieticians, Embalmers, Hostesses, Jockeys, Marine Second Engineers, Registered Nurses, Statisticians shall pay One Hundred Seventy Five Pesos (Php175.00) . TITLE II. CHAPTER 1, Article III, Section 26 of Ordinance No. 02-076 is hereby amended and shall be now read as follows: ARTICLE III Amusement Tax on Admission Section 26. Imposition of Tax. There is hereby imposed an amusement tax to be collected from the proprietor of theaters, concert halls, circuses, boxing stadium, cockpits and other places of amusement at a rate of not exceeding thirty percent (30%) of the gross receipts from admission fee. TITLE IV. CHAPTER I Mayor's Permit Fees for Business, Occupational and other Activities, ARTICLE II, Sanitary Inspection and Health Certificates, Section 74. Health Certificate Fee of Ordinance No. 02-076 is hereby amended and shall now be read as follows : HTSAEa ARTICLE II Sanitary Inspection and Health Certificates Section 74. Health Certificate Fee. All persons who will secure Medical Certificate from the City Health Office shall pay One Hundred Pesos (Php100.00). CHAPTER III. ARTICLE II, Section 105 (a)(b) of Ordinance No. 02-076 is hereby amended and shall now be read as follows: CHAPTER III Building Permits and Miscellaneous Fees ARTICLE II Processing Fee for Zoning or Locational Clearance Section 105(a). Application/filling fee, for every application for locational clearance irrespective of whether approved or not: motions for reconsideration, reclassification and for filling of complaints are as follows: 1) For Locational Clearance Php175.00 2) For motion for reconsideration Php525.00 3) For Petition/request for reclassification Php1,750.00 4) For filing of complaints except those involving pauper-litigation which shall be free of charge Php1,250.00 b. Processing fee for approved application or locational clearance whether the project or activity to be undertaken is conforming or non-conforming in accordance with the following schedules: 1) Residential (single detached and duplex style) Php3.00/ Square Meter 2) Commercial establishments including apartments, mass housing, townhouses constructed primarily Php7.50/ for gain purposes Square Meter 3) Industrial establishment Php9.00/ Square Meter 4) Memorial Parks/cemeteries Php4.00/ Square Meter 5) Institution (schools, hospitals, etc.) Php5.50/ Square Meter 6) Agro Industrial 7) Telecommunication/towers Php7.50/ Square Meter 8) Billboards Php10.00/ Square Foot 9) Yards utilized for commercial Php3.00/ Square Meter 10) Yards utilized for industrial Php2.50/ Square Meter 11) All types of renovation 75% of corresponding prescribed rates TITLE IV, CHAPTER II, ARTICLE II, Section 87 of Ordinance No. 93-35 as amended by Ordinance No. 02-052 is hereby amended and shall now be read as follows: CaHAcT TITLE IV CHAPTER II ARTICLE II Section 87. The following fees shall be collected for services rendered by the Civil Registry: a) Registration of Birth, Founding Marriage and No Fees Death b) Late registration (Processing Fee) Php150.00 c) Marriage Application Fee Php100.00 d) Marriage License Fee Php200.00 e) Solemnization Fee Php500.00 f) Filing of Supplemental Birth, Death and Marriage Certificate Php75.00 g) Registration of Court Decrees/Orders: g.1. Adoption/Rescission of Adoption Php150.00 g.2. Annulment of marriage/declaration of absolute nullity of marriage/legal separation/ court order setting aside the decree of legal separation Php300.00 g.3. Change of name or correction of Entry Php300.00 g.4. Civil Interdiction Php200.00 g.5. Declaration of Presumptive Death of the absent spouse/judicial declaration of absence Php200.00 g.6. Compulsory recognition of illegitimate Child Voluntary Recognition of Minor Illegitimate child Php200.00 g.7. Appointment of guardian/termination of guardianship Php200.00 g.8. Judicial Determination of Filiations Php200.00 g.9. Judicial determination of the fact of reappearance of absent spouse, if disputed Php200.00 g.10. Service Fee 1,000.00 n) Civil documents in Security Paper and the like issued by the Local Civil Registry Office 75.00 o) Civil documents secured at NSO-OCRG Extension Office Civil Registry System (CRS) Service Outlet 75.00 SECTION 2. Separability Clause. If for any reason/s, any section or provision of this ordinance shall be held unconstitutional or invalid, no other section or provision thereof shall be affected thereby. SECTION 3. Repealing Clause. All ordinances or any part/s thereof, in conflict or inconsistent with the provisions of this Ordinance are hereby repealed, amended, or modified accordingly. SECTION 4. Effectivity. This ordinance shall take effect immediately after publication in a newspaper of general circulation.
