July 16, 2012 MUNTINLUPA CITY ORDINANCE NO. 081-12 AN ORDINANCE AMENDING THE EXISTING VALUATION IN THE SCHEDULE OF FAIR MARKET VALUES BY THE CITY ASSESSOR'S OFFICE, PARTICULARLY THE SCHEDULE OF BASE UNIT ON CONSTRUCTION COSTS FOR NEW BUILDINGS AND OTHER IMPROVEMENTS, WHOSE REAL PROPERTY ASSESSMENT AND PAYMENT OF CORRESPONDING REAL PROPERTY TAX WILL BE EFFECTIVE BEGINNING THE YEAR 2013 Sponsored by: Hon. Ulanday WHEREAS , Section 129 of Republic Act 7160, otherwise known as the New Local Government Code of 1991 and Section 5, Article X of the 1987 Philippine Constitution, state and declare, "that each local government units shall have the power to create its own sources of revenues and to levy taxes, fees and charges, subject to such limitations and guidelines as the Congress may provide consistent with the basic policy of local autonomy" ; WHEREAS , Section 214 of Republic Act 7160, otherwise known as the New Local Government Code of 1991, states that, "the provincial, city or municipal assessor may recommend to the Sanggunian concerned amendments to correct errors in valuation in the schedule of fair market values, x x x" ; WHEREAS ,the present Schedule Base Unit on Construction Costs are by now unrealistic and too low compared to prevailing building construction costs; WHEREAS ,neighboring cities have already increased their Base Unit on Construction Cost to a more reasonable and realistic schedule of values; WHEREAS ,the City will stand to lose substantial revenue in real property tax using the existing Base Unit on Construction Cost considering the present boom in construction; NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED ,by the 6th Sangguniang Panlungsod in session assembled that. SECTION 1. The new Schedule of Base Unit on Construction Costs for building shall be applicable to new buildings, houses, and other structures whose Certificate of Occupancy are issued beginning July 2012. CAIHTE SECTION 3. The new Schedule of Base Unit on Construction Costs for building shall be applicable to all re-assessment/reclassification due to renovation of buildings, houses, and other structures to take effect on January 2013. SECTION 4. The City Assessors shall apply the Old Schedule of Base Unit on Construction Costs in the appraisal and assessment for all new houses, buildings and other structures constructed before July 2012. SECTION 5. Repealing Clause . All ordinance or part or parts thereof which are inconsistent with any of the provisions of this ordinance are hereby repealed or modified accordingly. SECTION 6. Separability Clause . If for any reason/s, and section or provision of this Ordinance shall be held to be unconstitutional or invalid, other sections or provisions hereof which are not affected thereby shall continue to be in full force and effect. SECTION 7. Publication . This ordinance shall be published once (1) in a newspaper of general circulation. SECTION 8. Effectivity Clause .
