June 27, 2002 MUNTINLUPA CITY ORDINANCE NO. 052-02 AN ORDINANCE AMENDING SECTIONS 87 AND 88, ARTICLE II, CHAPTER II OF ORDINANCE NO. 93-35 ADOPTING A REVENUE CODE OF THE MUNICIPALITY OF MUNTINLUPA Sponsored by: Hon. Joaquin Be it ORDAINED as it is hereby ORDAINED by the City Council of Muntinlupa in its regular session duly assembled that: WHEREAS, Section 87 of Article II, Chapter II of Ordinance No. 93-35 allows the imposition and collection fees for the services rendered by the Civil Registry; WHEREAS, the Civil Registry fees imposed by the City Government of Muntinlupa have remained the lowest in comparison with fees being collected by the neighboring cities and municipalities; WHEREAS, there is a need to impose new and/or increased rates of Civil Registry fees to support the increasing cost of rendering Civil Registry services and to generate additional revenues to support the numerous projects of the City Government which shall all redound to the benefit of the general public especially the constituents of the City of Muntinlupa; cTaDHS WHEREAS, City Ordinance No. 01-076 and Memorandum of Agreement with the Office of the Civil Registrar General, National Statistics Office signed on November 24, 1999 empowers the OCRG-NSO Extension Office which is under the supervision of the Local Civil Registry Office to issue civil documents in security paper and the like; WHEREAS, Republic Act No. 9048 authorizing the City or Municipal Civil Registrar of the Consul General to correct a clerical or typographical error in an entry and/or change of first name or nickname in the civil register without need of a judicial order amending for this purpose Articles 376 and 412 of the Civil Code of the Philippines, provides on its Section 8 the payment of fees as a condition for accepting the petition; WHEREAS, the Local Civil Registry Office receives from time to time requests for verification and/or issuance of civil registry record/document from foreign countries; NOW, THEREFORE, be it enacted by the City Council of Muntinlupa: SECTION 1. Sections 87 and 88, Article II, Chapter II of Ordinance No. 94-35 is hereby amended as follows: "Section 87. Imposition of fees . The following fees shall be collected for services rendered by the Civil Registry: AHcaDC a. Registration of Birth, Foundling Marriage and Death No fees b. Late Registration (Processing Fee) 100.00 c. Marriage Application Fee 50.00 d. Marriage License Fee 50.00 e. Solemnization Fee 100.00 f. Filing of Supplemental Birth, Death, and Marriage Certificate 50.00 g. Registration of Court Decrees/Orders: g.1 Adoption/Rescission of Adoption 100.00 g.2 Annulment of Marriage/Declaration of Absolute Nullity of Marriage/Legal Separation/Court Order Setting Aside the Decree of Legal Separation. 100.00 g.3 Change of Name or Correction of Entry 100.00 g.4 Civil Interdiction 100.00 g.5 Declaration of Presumptive Death of the Absent Spouse/Judicial Declaration of Absence 100.00 g.6 Compulsory Recognition of Illegitimate Child/ Voluntary Recognition of Minor Illegitimate Child 100.00 g.7 Appointment of Guardian/Termination of Guardianship 100.00 g.8 Judicial Determination of Filiations 100.00 g.9 Judicial Determination of the Fact of Reappearance of Absent Spouse, if disputed 100.00 g.10 Naturalization Certificate/Cancellation of Naturalization Certificate 100.000 g.11 Separation of Property/Revival of Former Property Regime 100.00 g.12 Emancipation of Orphaned Minor 100.00 g.13 Other Registrable Court Decrees/Orders 100.00 h. Civil Documents in Security Paper and the like Issued by the Local Civil Registry Office 50.00 per copy o. Civil Documents secured at NSO-OCRG Ext. Office/ Civil Registry System (CRS) Service Outlet 50.00 per copy SEC. 88. The Civil Registrar or equivalent functionary shall issue the following documents without payment of the fee herein required: a. Certified copy of civil documents for official use at the request of a competent court or government agency; b. Certified copy of birth certificate of a child reaching school age when such certificate is required for admission to primary grades of public school within the City; The Civil Registrar or equivalent functionary shall issue the above documents requested by foreign countries with an additional amount of US$20.00 or its equivalent as handling fee. SECTION 2. Repealing Clause . All rules and regulations or any part thereof, in conflict or inconsistent with the provisions of this Ordinance are hereby repealed, amended, or modified accordingly.
