Gonzaga WHEREAS , Republic Act 7160, otherwise known as the Local Government Code of 1991, provides that, " the local government units shall have the power to create their own sources of revenues and to levy taxes, fees and charges which shall accrue exclusively for their use and disposition and which shall retained by them " ; WHEREAS , under Section 458, No. 1 (vi) of Republic Act 7160, otherwise known as the New Local Government Code of 1991, provides that, " the Sangguniang Panlungsod shall protect the environment and impose appropriate penalties for acts which endangered the environment x x x such as activities which result in pollution, destruction of rivers and lakes, or of ecological imbalance " ; WHEREAS , pursuant to the power of the City to generate revenues and levy taxes, there is a need to impose taxes on the businesses using the natural resources of the city such as the Laguna lake; NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED , by the 8th Sanggunian duly assembled the following: SECTION 1. Title . This ordinance shall be known as an " Ordinance imposing fixed tax on business on fishpond, fishpens or fish breeding grounds, per hectare or fraction thereof ." SECTION 2. Coverage . This ordinance shall cover the owners and operators regardless of the size of the fishpond, fishpens or fish breeding grounds within the City of Muntinlupa. SECTION 3. Imposable Business Tax . The amount of One Thousand Four Hundred Pesos (Php1,400.00) per hectare or fraction thereof is hereby imposed on owners and operators of fishpond, fishpens or fish breeding grounds. SECTION 4. Separability Clause . If, for any reason or reasons, any part or provisions of this ordinance shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect. SECTION 5. Repealing Clause . All previous ordinances inconsistent with this ordinance shall be deemed repealed or modified accordingly. SECTION 6. Effectivity Clause . This ordinance shall take effect fifteen (15) days after its completion of its publication in a newspaper of general circulation.
