Limos RESOLUTION ENACTING AN ORDINANCE AMENDING PARAGRAPH 1, SECTION 31.01, ARTICLE I OF MUNICIPAL TAX ORDINANCE NO. 1, SERIES OF 2007, OTHERWISE KNOWN AS THE REVISED MUNICIPAL REVENUE CODE OF THE MUNICIPALITY OF POLOMOLOK, PROVINCE OF SOUTH COTABATO FOR 2007 WHEREAS, Paragraph 1, Section 31.01, Article I of Tax Ordinance No. 01, series of 2007, otherwise known as the Revised Municipal Revenue Code of the Municipality of Polomolok, Province of South Cotabato for 2007 provides for the charges of franchise fee for the operation of tricycles-for-hire in the Municipality of Polomolok, Province of South Cotabato; WHEREAS, the aforecited provision of the Municipality's Revised Revenue Code of 2007 contradicts with the provisions of Municipal Ordinance No. 1, series of 1994, which resulted to confusion in the implementation of the said ordinance as franchises issued to tricycles-for-hire is valid for three years as provided for in Municipal Ordinance No. 1, series of 1994, hence there is no need to collect franchise fee annually as required of in Paragraph 1, Section 31.01, Article 1 of the Municipality's Revised Revenue Code for 2007; WHEREAS, to have consistency in the interpretation and application of the aforecited provisions of the Revised Municipal Revenue Code for 2007, there is a need to amend the same by deleting the word "annual" in Paragraph 1, Section 31.01, Article I of Tax Ordinance No. 01, series of 2007; WHEREFORE, premises considered, upon motion of Councilor Jude G. Bontuyan, and unanimously seconded; RESOLVED, as it is hereby resolved, to enact an ordinance amending Paragraph 1, Section 31.01, Article I of Municipal Tax Ordinance No. 1, series of 2007, otherwise known as the Revised Municipal Revenue Code of the Municipality of Polomolok, Province of South Cotabato for 2007. UNANIMOUSLY CARRIED. ADOPTED by the Sangguniang Bayan on September 3, 2009. I hereby CERTIFY to the correctness of the foregoing resolution. MUNICIPALITY OF POLOMOLOK GENERAL ORDINANCE NO. 08-09 AN ORDINANCE AMENDING PARAGRAPH 1, SECTION 31.01, ARTICLE I OF THE MUNICIPAL TAX ORDINANCE NO. 1, SERIES OF 2007, OTHERWISE KNOWN AS "THE REVISED MUNICIPAL REVENUE CODE OF THE MUNICIPALITY OF POLOMOLOK, PROVINCE OF SOUTH COTABATO FOR 2007" BE IT ORDAINED, by the Sangguniang Bayan of Polomolok, South Cotabato in session assembled that: cAaDHT SECTION 1. Paragraph 1, Section 31.01, Article I of Municipal Tax Ordinance No. 1, series of 2007, is hereby amended to read as follows: "Section 31.01. Imposition of Fees. There shall be collected franchise fee in the amount of Five Hundred Pesos (P500.00) for the operation of tricycle-for-hire." SECTION 2. This Ordinance shall take effect upon approval. SO ORDAINED.
