March 28, 2018 MINA MUNICIPAL ORDINANCE NO. 341-18 AN ORDINANCE AMENDING PORTION OF ARTICLE M OF THE REVISED MUNICIPAL REVENUE CODE, RE: ASSESSMENT AND COLLECTION OF FEES AFFECTING THE PROCESSING AND ISSUANCE OF BUILDING PERMITS, OCCUPANCY AND OTHER REGULATORY FUNCTIONS AS PROVIDED THE RULES AND REGULATIONS IMPLEMENTING PD 1096, OTHERWISE KNOWN AS THE NEW NATIONAL BUILDING CODE, BY ADDING ANOTHER SECTION THEREFOR WHEREAS , Rule III, Paragraph 2 of Rules and Regulations Implementing PD 1096, otherwise known as the New National Building Code provides that: a.) No person, firm or corporation, including any agency or instrumentality of the government shall construct, alter, repair, convert, use, occupy, move, demolish and add any building/structure or any portion thereof or cause the game to be done, without first obtaining a building therefore, from the Building Permit shall be signed by the owner/applicant, design professionals and duly licensed architect or engineer who will undertake full time inspection and supervision of the construction/installation work. Said application shall be duly notarized, and shall be accompanied by the various ancillary and accessory permits, plans and specifications signed and sealed by the corresponding design professionals who shall responsible for the comprehensiveness and correctness of the plans in compliance to the code and its IRR and to all applicable referral codes and professional regulatory laws. WHEREAS , per observation, many residential and other building owners caused the construction of their houses/establishments without first obtaining the corresponding necessary permits in violation of Rule III, paragraph 2 (a) and (b) of the code above-stated. NOW, THEREFORE: BE IT ORDAINED by the Sangguniang Bayan of Mina in session assembled that: SECTION 1. Section M of the Revised Municipal Revenue Code shall hereby amended by providing additional section therefore to be read as "Section 3M.04"; SECTION 2. Section 3M.04 of the Revised Municipal Revenue Code, shall cover the nature of application, processing and collection of permits for those buildings already completed and occupied without the corresponding necessary permits obtained, as follows: a.) That in consideration to all residential, commercial, industrial and commercial building already erected and occupied respective owners shall be required to comply with the provisions of Rule III, Paragraph 2 (a) and (b) of the Implementing Rules and Regulations Implementing PD 1096, otherwise known as the New National Building Code without penalty. Penalty shall commence upon the lapse of 12 months or one (1) year period. Provided a temporary permit shall be first obtained. b.) That in consideration with those buildings of any kind with lower and minimal cost whose owner cannot afford to pay professional signatory fees shall be allowed to commence their construction works provided they will pay temporary permit until such time that they can comply with all requirements provided by PD 1096. SECTION 3. This ordinance shall take effect upon approval. ADOPTED this 28th day of March 2018 , on motion of Hon. Jose G. Salanio Jr. , duly seconded Hon. Rose Kareen S. Defensor . APPROVED.
