August 17, 2017 MINA MUNICIPAL ORDINANCE NO. 325-17 AN ORDINANCE AMENDING PORTION OF ARTICLE M FOR BUILDING PERMIT AND RELATED FEES OF THE REVISED MUNICIPAL REVENUE CODE, SPECIFICALLY SECTION 3M.01 THEREOF, RE: ASSESSMENT AND COLLECTION OF FEES WHEREAS , Section 3M.01 of the Revised Municipal Revenue Code of the Municipality of Mina states that, "There shall be assessed and collected fees and charges for services rendered in connection with the processing and issuance of building permits, building occupancy and the performance of other regulatory functions on a person, firm and corporation before they are allowed to erect, construct, alter, move, convert or demolish any private or public building or structure within the Municipality of Mina in accordance with the rates prescribed un the rules and regulations implementing Presidential Decree No. 1096"; WHEREAS , this Ordinance seek to introduce an additional statement to such provision above-stated as regards to the construction or erection of buildings or structures without complying first the required documents, particularly the building permit. NOW, THEREFORE: BE IT ORDAINED by the Sangguniang Bayan of Mina, Iloilo in session assembled that: SECTION 1. This Ordinance shall be called "An Ordinance amending portion of Article M of the Revised Municipal Revenue Code of the Municipality of Mina, specifically Section 3M.01 thereof." SECTION 2. There shall be added a statement to Section 3M.01 of the Revised Municipal Revenue Code to be read as follows: In case of non-compliance of the herein mentioned requirements, proponents or owners who have started their construction without the permit shall be required to suspend or stop their construction pending compliance of their regulatory functions, and they shall be given an extension of six (6) months to comply with all the requirements prescribed in the rules and regulations implementing PD 1096 known as the New Building Code of the Philippines. SECTION 3. Proponents or owners who continue to insist violating this Ordinance shall be fined in accordance with the penalty provided in PD 1096 implementing rules and regulations. SECTION 4. This Ordinance shall take effect upon approval. ADOPTED this 17th day of August 2017 , on motion of Hon. Jose G. Salanio Jr. , duly seconded by Hon. Juanito D. Grabato Jr. APPROVED.
