October 9, 1992 MEMORANDUM CIRCULAR NO. 11 REQUIRING ALL DEPARTMENT SECRETARIES AND HEADS OF BUREAUS AND OTHER GOVERNMENT AGENCIES TO FILE COPIES OF ALL RULES ADOPTED BY THEIR RESPECTIVE DEPARTMENTS, BUREAU OR AGENCY WITH THE UNIVERSITY OF THE PHILIPPINES LAW CENTER WHEREAS, Section 3 of Book VII of the Administrative Code of 1987 requires every agency in the Government to file three (3) certified copies of every rule adopted by it with the University of the Philippines Law Center; WHEREAS, the same section requires the Records Officer of the agency or his equivalent functionary to carry out the required filing under pain of disciplinary action; DcCITS WHEREAS, the term "agency" as defined in Section 2, Book VII of the Administrative Code means "any department, bureau, office, commission, authority or officer of the National Government authorized by law or executive order to make rules, issue licenses, grant rights or privileges, and adjudicate cases; research institutions with respect to licensing functions; government corporations with respect to functions regulating private right, privilege, occupation or business; and officials in the exercise of disciplinary power as provided by law"; WHEREAS, the term "rule" as likewise defined therein means "any agency statement of general applicability that implements or interprets a law, fixes and describes the procedures in, or practice requirements of, an agency, including its regulations; including memoranda or statements concerning the internal administration or management of an agency not affecting the rights of, or procedure available to the public"; AcHEaS WHEREAS, each rule as provided in Section 4, Book VII of the Administrative Code shall become effective fifteen (15) days from the date of filing with the UP Law Center "unless a different date is fixed by law, or specified in the rule in cases of imminent danger to public health, safety and welfare, the existence of which must be expressed in a statement accompanying the rule"; IN VIEW THEREOF, all Department Secretaries, Heads of Bureaus, Commissions and other governmental agencies are hereby directed to file three (3) certified copies of every rule adopted by their respective department, bureau, commission or agency with the UP Law Center in Diliman, Quezon City. This Circular shall take effect immediately. Manila, October 9, 1992
