March 28, 2008 MARIKINA CITY ORDINANCE NO. 060-08 ORDINANCE CONDONING THE ARREARS ON REAL PROPERTY TAX DUE ON IMPROVEMENT FOUND UNDER TCT NO. 197152 OWNED BY CARLOS DE GUZMAN Introduced by: Hon. Councilor Serafin Y. Bernardino WHEREAS, Section 192 of the Local Government Code of the Philippines expressly provides that: cIECTH "local government units may, through ordinances duly approved, grant tax exemption, incentives or reliefs under such terms and conditions as they may deem necessary." WHEREAS, the above-mentioned authority to grant exemption is likewise expressly provided for under sub-paragraph (ii), paragraph 2, (a) Section 148 of the same code that: "Subject to the provisions of book 11 of this code and applicable laws and upon the majority vote of all the members of sangguniang panlungsod, enact ordinances levying fees and charges, prescribing the rates thereof for general and specific purposes, granting tax exemptions, incentives or relief." WHEREAS, the City Government of Marikina purchased a property lot located in Sto. Nio, Marikina City described under Transfer Certificate of Title No. 197152 owned by Spouses Danilo C. De Guzman and Corazon D. De Guzman, however as verified in the tax declaration, an improvement appeared in the record thereof under the name of Carlos De Guzman; TCAHES WHEREAS, said improvement was no longer inexistence and is now subject for cancellation at the office of the city assessor to conform to the present status of the property; WHEREAS, the City Government has purchased the abovementioned property for its project in consonance with the river ferry station project of DPWH and is now in the process of transferring the title in favor to the city and in consideration thereof it is hereby resolved to condone from payment of the arrears in real property tax the improvement which is no longer in existence; NOW THEREOF, BE IT ORDAINED, AS IT IS HEREBY ORDAINED by the SANGGUNIANG PANLUNGSOD OF MARIKINA, in session duly assembled, that the City Government of Marikina hereby exempts the real property on improvement found under TCT No. 197152 owned by the heirs of Carlos De Guzman from payment of arrears in real property tax; Resolved further that copies of this Ordinance be furnished to the Honorable City Mayor, Ma. Lourdes C. Fernando, the City Assessor, the City Treasurer and to all other offices and agencies of the City Government concerned, for their information and appropriate action.
