September 20, 2017 MARIKINA CITY ORDINANCE NO. 042-17 ORDINANCE AMENDING SECTION 3 OF ORDINANCE NO. 59 SERIES OF 2016, ENTITLED "ORDINANCE GRANTING AMNESTY ON INTERESTS OF DELINQUENT REAL PROPERTY TAXPAYERS IN THE CITY OF MARIKINA" Introduced by: Councilor Serafin Y. Josef WHEREAS , Section 192 of the Local Government Code of 1991 grants the power to grant amnesty which states: "Local government units may through ordinances duly approved, grant tax exemption, incentives or reliefs such under terms and conditions as they may deem necessary." WHEREAS , Ordinance No. 59, Series of 2016, provides for a 100% grant of amnesty on the interests of unpaid real property taxes to delinquent taxpayers that will end on June 30, 2017; WHEREAS , there is a further need to extend the period of availment of the amnesty provided for by the said Ordinance to further boosts the City Government's Tax Collection and to provide more time for delinquent taxpayers to settle their arrears; NOW THEREFORE , be it ordained by the CITY COUNCIL OF MARIKINA, in session duly assembled that: SECTION 1. Section 3 of Ordinance No. 59 Series of 2016 is hereby amended as follows: "The grant of amnesty to the interests of delinquent real property taxpayers starts upon approval of this ordinance and ends on June 30, 2018. Notwithstanding the aforesaid amnesty, the right of the City to initiate and/or proceed with legal actions for the collection of tax delinquency, such as, but not limited to, garnishment, levy a f personal property and/or auction of real property, shall continue and subsist." SECTION 2. Repealing Clause . All Ordinances, resolutions, orders and issuances inconsistent herewith are hereby repealed and/or modified accordingly. SECTION 3. Effectivity . This Ordinance shall take effect upon its approval. UNANIMOUSLY ENACTED by the SANGGUNIANG PANLUNGSOD of MARIKINA during its 35th Regular Session, this 20th day of September 2017.
