February 24, 2010 MARIKINA CITY ORDINANCE NO. 012-10 ORDINANCE CONDONING THE PAYMENT OF REAL PROPERTY TAXES OF A PARCEL OF LAND LOCATED ALONG SHOE AVENUE EXTENSION IN BARANGAY STO. NIO, MARIKINA CITY FROM 1985 UP TO THE LAST QUARTER OF 2009 Introduced by: Councilor Serafin Y. Bernardino WHEREAS, Section 192 of the Local Government Code of 1991 provides that: SHCaDA "...Local government units may, through ordinances duly approved, grant tax exemptions, incentives or relief such terms and conditions as they seem necessary ..."; WHEREAS, sub-paragraph (ii), paragraph (2) (a) of Section 458 of the same Code likewise expressly provides that: ". . . Subject to the provisions of Book II of this Code and applicable laws and upon the majority vote of all members of Sangguniang Panlungsod, enact ordinances levying fees and charges, prescribing the rates thereof for general and specific purposes, granting tax exemptions, incentives or relief . . ."; WHEREAS, a certain parcel of land consisting an area of One Hundred Ninety Four Square Meters (194 sq. m.),owned by the late Spouses Domingo O. Sanchez and Matilde Balderama, is identified as part of the Marikina Sports Park, specifically the portion presently occupied by the People's Park and partly occupied as sidewalk; WHEREAS, the above-subject property was awarded to Spouses Domingo O. Sanchez and Matilde Balderama as evidenced by a Deed of Absolute Sale executed by and between the GSIS and Spouses Sanchez on December 27, 1972; WHEREAS, entries found at the City Assessors Office and the City Treasury reflect that the property owners are delinquent from payment of the real property taxes from calendar years 1985 until 2009; WHEREAS, the City Government of Marikina deems it necessary and justified to condone the payment of the real property taxes due them in view of the fact that ever since the establishment of the Marikina Sports Center and up to the present, the heirs of the late Spouses Domingo have had no reasonable use of the property; NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED by the SANGGUNIANG PANLUNGSOD of MARIKINA, in session duly assembled: IScaAE SECTION 1. The City Government of Marikina hereby condones the payment of real property taxes of a parcel of land with an area of One Hundred Ninety Four Square Meters (194 sq.m.),located along Shoe Avenue Extension in Barangay Sto. Nio, Marikina City from 1985 up to the last quarter of 2009. SECTION 2. This Ordinance shall take effect upon approval. APPROVED by the CITY COUNCIL of MARIKINA this 24th day of February, 2010. I hereby certify to the passage of the foregoing Ordinance which was duly approved by the City Council of Marikina during its 8th Regular Session held on February 24, 2010. (SGD.) LOLITA E.
