January 13, 2010 MARIKINA CITY ORDINANCE NO. 003-10 ORDINANCE AMENDING ORDINANCE NO. 162, SERIES OF 2009 ENTITLED "ORDINANCE GRANTING FIFTY PERCENT (50%) DISCOUNT ON THE RESIDENTIAL REAL PROPERTY TAX DUE FOR CALENDAR YEAR 2010 IN THE CITY OF MARIKINA" Introduced by: Councilor Ponciano T. Ubaldo, Jr. WHEREAS, on December 16, 2009, the 5th City Council passed Ordinance No. 162, Series of 2009 entitled "Ordinance Granting Fifty Percent (50%) Discount on the Residential Real Property Tax Due for Calendar Year 2010 in the City of Marikina" during its 48th Regular Session; caCSDT WHEREAS, Section 251 of the Local Government Code expressly provides the limitation on granting tax discount on real property tax, as it states: "SEC. 276. Tax Discount for Advanced Prompt Payment. If the basic real property tax and the additional tax accruing to the SEF are paid in advance in accordance with the prescribed schedule of payment as provided under Section 250, the sanggunian concerned may grant a discount not exceeding twenty percent (20%) of the annual tax due." ... WHEREAS, Section 276 of the Local Government Code provides: "SEC. 276. Condonation or Reduction of Real Property Tax and Interests. In case of a general failure of crops or substantial decrease in the price of agricultural or agri-based products or calamity in any province, city or municipality, the sanggunian concerned, by ordinance passed prior to the first (1st) day of January of any year and upon recommendation of the Local Disaster Coordinating Council, may condone or reduce, wholly or partially, the taxes and interest thereon for the succeeding year or years in the city or municipality affected by the calamity." ... WHEREAS, to avoid any confusion or misunderstanding in the interpretation and implementation of Ordinance No. 162 Series of 2009, there is a need to change some of the terms that were used therein; NOW THEREFORE BE IT ORDAINED AS IT IS HEREBY ORDAINED by the SANGGUNIANG PANLUNGSOD OF MARIKINA, in session duly assembled: SECTION 1. The title of Ordinance No. 162, Series of 2009 is amended to read as follows: "Ordinance Reducing the Residential Real Property Tax Due for Calendar Year 2010 in the City of Marikina by Fifty Percent (50%)." SECTION 2. Section 1 of the abovementioned ordinance shall be read as follows: "SECTION 1. The real property tax due for Calendar Year 2010 in the City of Marikina is hereby reduced by Fifty Percent (50%). SECTION 3. Section 2 of the abovementioned ordinance shall be read as follows: "SECTION 2. This special privilege for Calendar Year 2010 is herein granted subject to the following conditions: cHEATI a. The 50% reduction shall be applied on the Total Gross Tax Due and shall be inclusive of the prompt payment discount of Ten Percent (10%) and the additional MCF Privilege cardholder discount of Ten Percent (10%). b. The 50% reduction is granted provided the tax is paid in full on or before June 30, 2010. SECTION 4. This Ordinance shall take effect upon its approval.
