April 19, 2011 MANILA CITY ORDINANCE NO. 8229 AN ORDINANCE EXEMPTING SMART COMMUNICATIONS INCORPORATED FROM PAYMENT OF REAL PROPERTY TAXES ON ALL MACHINERY/EQUIPMENT AND LOCAL FRANCHISE TAX PRINCIPAL AUTHOR: Hon. Maria Sheilah H. Lacuna-Pangan, Majority Floor Leader Be it ordained by the City Council of Manila, in session, assembled, THAT: IASEca SECTION 1. The SMART COMMUNICATIONS, INC. (SMART) is hereby given tax exemption from the payment of the following taxes, to wit: a) Real property tax on all machinery/equipment that are directly used for a telecommunication business; b) Local franchise tax. SECTION 2. Regulatory fees and other taxes not expressly mentioned in the next preceding section are not covered by this Ordinance. SECTION 3. If for any reason or reasons, any provision of this Ordinance shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect. SECTION 4. This Ordinance shall take effect upon its approval. Enacted by the City Council of Manila at its regular session today, April 19, 2011.
