MANDAUE CITY ORDINANCE NO. 13-2015-1056 AN ORDINANCE FURTHER AMENDING ARTICLE V, SECTION 35-A OF ORDINANCE NO. 13-2014-935, FURTHER AMENDING ARTICLE V OF SECTION 35 OF CITY ORDINANCE NO. 99-051, OTHERWISE KNOWN AS THE REVENUE CODE OF THE CITY OF MANDAUE, AS AMENDED The THIRTEENTH SANGGUNIANG PANLUNGSOD of MANDAUE, with members in session duly assembled, hereby ORDAINS that: SECTION 1. Article V, Section 35-A of Ordinance No. 13-2014-935 (further amending Article V, Section 35 of Ordinance No. 99-051, the Revenue Code of Mandaue City as amended) is hereby amended to read as follows: "SECTION 35-A. The following charges shall be collected from the owner, or in behalf of the owners, the carrier of shipment of fish or other aquatic products in commercial quantity landed in the Mandaue City Fisheries wharf or in any point within the City of Mandaue: a.) Regardless of its volume or quantity, unless the shipment or shipments are covered by an auxiliary invoice from the point of source or origin, the following shall be paid: Fishing Boat Two Hundred Pesos (Php200.00) Lantsa Five Hundred Pesos (Php500.00) Commercial Fishing Vessel One Thousand Pesos (Php1,000.00) However, the same shall only apply to fishery and other aquatic products such as seaweeds and all others which are not fresh fish; b.) Five Pesos (Php5.00), as inspection fee per receptacle (baera) of fresh fish. This fee shall only apply to the inspection of fresh fish. A "baera" is a receptacle made usually of steel that looks like a tub because of its wide circular opening and a smaller circular base, commonly used in commercial fishing as the base of measurement for every fish catch; c.) Three Hundred Pesos (Php300.00), as a standby fee or docking fee. This shall refer to each dock, whether to load or unload shipment of fish or any other aquatic products; d.) Three Hundred Pesos (Php300.00), as hauling fee. There shall be collected a hauling fee for the transportation of the shipment of fish or any other aquatic products. This shall refer to each entrance of the vehicle. Should the shipment be found or reasonably suspected to be illegally caught with dynamite or poisoned, or otherwise laced with formalin or other hazardous chemicals, it shall immediately be impounded and submitted for chemical analysis. A fish warden trained to detect illegally caught or chemically-laced fish, who is duly authorized to issue official receipts and handle public funds, shall be assigned to collect the prescribed fees and charges." SECTION 2. Repealing Clause . Any and all other existing ordinances or parts thereof, specifically Section 1 of Ordinance No. 13-2014-935, amending Article V, Section 35 of City Ordinance No. 99-051, otherwise known as the "Revenue Code of the City of Mandaue," containing provisions which are inconsistent or contrary to any of the provisions declared in this Ordinance are hereby deemed repealed, amended or modified accordingly. SECTION 3. Separability Clause . If any part of this Ordinance, is for any reason, declared to be unconstitutional or invalid, the other parts or provisions hereof which are not affected thereby shall continue to be valid and enforceable. SECTION 4. Effectivity Clause . This amendatory Ordinance shall take effect immediately upon approval after its publication in a newspaper of general circulation. ENACTED without objection after its second and final reading on October 6, 2015 as proposed by Honorable Jimmy C.
