An Ordinance Further Amending Section 35, Article V of Ordinance No. 99-051, Otherwise Known as The Revenue Code of the City of Mandaue

MANDAUE CITY ORDINANCE NO. 12-2011-614 AN ORDINANCE FURTHER AMENDING SECTION 35, ARTICLE V OF ORDINANCE NO. 99-051, OTHERWISE KNOWN AS THE REVENUE CODE OF THE CITY OF MANDAUE The TWELFTH SANGGUNIANG PANLUNGSOD of MANDAUE, with members in session duly assembled, hereby ORDAINS that: SECTION 1. The added provision after Section 35-d-3, Article V of the "Revenue Code of the City of Mandaue" as amended, is hereby amended and regulated to be read as follows: "(a) One-Hundred Fifty Pesos (Php150.00), regardless of its volume or quantity, unless the shipment or shipments are covered by an auxiliary invoice from the point of source or origin. However, the same shall only apply to fishery and other aquatic products other than fresh fish." SECTION 2. Repealing Clause . Any and all other existing ordinances or parts thereof specifically Section 35, Article V of Ordinance No. 051-1999, otherwise known as the "Revenue Code of the City of Mandaue" containing provisions which are inconsistent or contrary to any of the provisions hereof are hereby deemed repealed, amended or modified accordingly. SECTION 3. Separability Clause . If any part of this Ordinance, is for any reason, declared to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be valid and enforceable. SECTION 4. Effectivity Clause . This amendatory Ordinance shall take effect upon approval, immediately after its publication in a newspaper of general circulation. ENACTED without objection after its second and final reading on April 13, 2011 as proposed and motioned by Honorable Jimmy C. Lumapas, duly seconded by Honorables Demetrio C. Cortes, Jr., Elstone C. BERCEDE Vice-Mayor & Presiding Officer SUBJECT : Draft Ordinance No. 27-2011 Referred to this Committee for review is Draft Ordinance No. 27-2011 "An Ordinance further amending Section 35 Article V of City Ordinance No. 99-051 or otherwise known as the "Revenue Code of the City of Mandaue." The Committee recognizes the need to increase the fees and charges imposed on fishery and other aquatic products other than fresh fish ( e.g. , "lato," crabs, clams and shells, etc.) from Php75.00 to Php150.00, regardless of its volume or quantity, unless such shipment/s are covered by an auxiliary invoice from the point of source or origin. Most fishing vessel operators are not declaring the true number of their vessels arriving in our ports; they usually declare several vessels to be under only one owner in order to pay the minimum amount of Php75.00. Hence, there is a need to amend Section 35, par. (d), sub-par. (3a) of the Revenue Code of Mandaue and the same shall now read as follows: (a) ONE HUNDRED FIFTY PESOS (Php150.00), regardless of its volume or quantity, unless the shipment or shipments are covered by an auxiliary invoice from the point of source or origin. However, the same shall only apply to fishery and other aquatic products other than fresh fish. Wherefore, in view of the foregoing, the Committee recommends for the approval of the Ordinance, the same being consistent with the Revenue Code of Mandaue and other pertinent laws.
