An Ordinance Prescribing the Rates of Fees and Other Charges to be Collected on Certain Transactions with the Mandaluyong Housing and Development Department (MHDD)

September 17, 2014 MANDALUYONG CITY ORDINANCE NO. 562-14 AN ORDINANCE PRESCRIBING THE RATES OF FEES AND OTHER CHARGES TO BE COLLECTED ON CERTAIN TRANSACTIONS WITH THE MANDALUYONG HOUSING AND DEVELOPMENT DEPARTMENT (MHDD) BE IT ORDAINED by the Sangguniang Panlungsod of the City of Mandaluyong, in session assembled: SECTION 1. The following are the rates of fees and other charges to be collected on certain transactions with the Mandaluyong Housing and Development Department (MHDD): 1. Certification as a structured owner, renter/rent free occupant and a resident and Waiver/Affidavit as a requirement for securing electrical permit P55.00 2. All other certifications 55.00 3. Processing of applications for TCTs, filing and Follow-up with Register of Deeds and securing TCTs thereof: a. Contract price is less than P100,000.00 2,200.00 b. Contract price is P100,000.00 or over and Less than P300,000.00. 4,400.00 c. Contract price is over P300.000.00 6,600.00 The amounts to be paid to the Register of Deeds are for account of the awardees. 4. Boundary Settlement 550.00 PAYMENT OF CHARGES AND FEES. Payments shall be made at the City Treasurer's Office upon issuance of an Order of Payment from the Mandaluyong Housing and Development Department for any certification, processing of TCTs and boundary settlement requested. SECTION 2. All transfers of rights over housing units and landed estates approved by the City Government shall be implemented only upon compliance with the following conditions: a. Payment of 10% of Contract Price or P5,000.00, whichever is higher as Transfer Fee by the Transferor or by the Transferee. b. Payment of at least one half (1/2) of the arrearages of the Transferor. c. The Transferee shall religiously pay the remaining monthly amortizations and all the obligations of the Transferor to the Housing Association. SECTION 3. Transfer Certificates of Titles with prohibitions against transfers, mortgages, etc. annotated at the back of the titles may be permitted to be transferred or mortgaged only in certain justifiable or meritorious cases by the City Mayor or his duly authorized representative only upon payment of the above fees. SECTION 4. If the Transfer of Rights or the permission issued is for and in behalf of either or both parents, brothers, sisters, sons or daughters of the awardee, the Transferor shall pay at least one half (1/2) of the above fees. SECTION 5. Transfer of Rights by succession shall be subject to the payment of Transfer Fees as provided in Section 1 above, however, in consonance with Section 4 hereof. SECTION 6. Repealing Clause . Ordinance No. 399, S-2008 and any ordinance not consistent with the provisions of this Ordinance are hereby repealed. SECTION 7. This Ordinance shall take effect upon approval. ENACTED on this 17th day of September, 2014 in the City of Mandaluyong.
