MALAY MUNICIPAL ORDINANCE NO. 327-13 AN ORDINANCE PRESCRIBING CHARGES ON BIRTHING CLINIC SERVICES AND OTHER RELATED FEES Be it ordained by the Sangguniang Bayan of Malay in session duly assembled: SECTION 1. Rationale . The operation and maintenance of a birthing clinic requires adequate logistics in order to achieve its desired effectivity in delivering the required services. Toward this desirable end, fees and/or charges must be imposed in order to sustain its operations. Being one of the health services that the Local Government Unit is mandated to render to its constituents, charges are rationalized in favor of Malay residents as against non-Malay residents, hence this piece of legislation. SECTION 2. Fees/Charges. Birthing Clinic Services . On the services subsequently listed, the Municipal Birthing Clinic of Malay shall impose the following fees/charges: MALAY RESIDENTS NON-MALAY RESIDENTS Service Fee P1,200.00 P1,700.00 Newborn Screening Kit 600.00 600.00 Mother and Child Book 50.00 60.00 Miscellaneous Expense 200.00 300.00 Total P2,050.00 P2,660.00 The above-cited charges/fees do not include the amount of actual medical supplies used, which the recipient of the rendered services shall also pay as added cost. For purposes of this Ordinance, a Malay Resident shall mean one who concurs with all of the following qualifications: a) A resident of the Municipality of Malay for one (1) year or more; b) who owns or rents a house within the Municipality; c) who is living with his/her family within the Municipality; d) whose children are studying within the Municipality; and e) A registered voter within the Municipality and pays taxes thereon. A Non-Malay Resident, on the other hand, shall mean transients. SECTION 3. Separability Clause . If for any reason or reasons, any part or provision of this ordinance shall be declared unconstitutional or invalid, other parts or provisions thereof not affected shall continue to be in full force and effect. SECTION 4. Repealing Clause . Any ordinance, orders, rules and regulations or any part thereof which are inconsistent with this ordinance are hereby repealed or modified accordingly. SECTION 5.
