Yabut AN ORDINANCE GRANTING EXEMPTION FROM THE PAYMENT OF 10% AMUSEMENT TAX ON THE PROCEEDS OF THE TOKYO-MANILA JAZZ AND ARTS FESTIVAL 2014 THAT WILL BE HELD ON 17 OCTOBER 2014 AT THE PENINSULA HOTEL AND ON 18 OCTOBER 2014 AT ROCKWELL TENT, SUBJECT TO APPLICABLE LAWS, RULES AND REGULATIONS WHEREAS, Section 192 of the Local Government Code (RA 7160) states: "Section 192. Authority to Grant Tax Exemption Privileges. Local government units may, through ordinances duly approved, grant tax exemptions, incentives or reliefs under such terms and conditions as they may deem necessary." WHEREAS, Article F, City Ordinance No. 2004-A-025 (Revised Makati Revenue Code) categorically provides as follows: "SEC. 3F.03. Exemptions. The holding of operas, concerts, dramas, recitals, painting and art exhibitions, flower shows, musical programs, literary and oratorical presentations, except pop, rock, or similar concerts shall be exempt from the payment of the tax imposed herein but subject to permits and regulatory fees imposed in this Code." WHEREAS, the holding of such festival cited above, which focuses on the cultural exchange and artistic collaboration between Japan and the Philippines and likewise aims to serve as a conduit linking both cultures through music and other allied art forms, falls within one of the categories of the aforequoted exempted activities from the imposition of local amusement tax; WHEREAS, the abovementioned festival shall be exempted from the local amusement tax since proceeds shall benefit the young artists and musicians. NOW, THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED, BY THE SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, that: AcICHD SECTION 1. Exemption from the payment of 10% amusement tax on the proceeds of the Tokyo-Manila Jazz and Arts Festival 2014 that will be held on 17 October 2014 at the Peninsula Hotel and on 18 October 2014 at Rockwell Tent, is hereby granted, subject to applicable laws, rules and regulations. SECTION 2. Let copy of this Ordinance be furnished all departments, offices and agencies concerned for their information, guidance and reference. SECTION 3.
