Cruzado AN ORDINANCE GIVING TAX AMNESTY TO THE BUSINESS ESTABLISHMENTS FOR BUSINESS TAXES AND REAL ESTATE TAX FOR RESIDENTS AFFECTED BY THE GAS LEAK AT THE WEST TOWER CONDOMINIUM, BARANGAY BANGKAL, MAKATI CITY, SUBJECT TO APPLICABLE LAWS, RULES AND REGULATIONS WHEREAS, the Makati City government is aware that the issues arising from the West Tower oil leak "were far from resolved" despite a recent court ruling; WHEREAS, in view of the continuing hazards posed by such massive spill to the lives of West Tower Condominium residents and homeowners, the city government deems it necessary to grant their request for tax amnesty for 2012 and 2013. HEITAD NOW, THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED BY THE SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, that: SECTION 1. Business establishments and residents/homeowners affected by the gas pipe leak at West Tower Condominium in Barangay Bangkal, Makati City are hereby granted tax amnesty on business taxes and real estate tax, respectively, subject to applicable laws, rules and regulations. SECTION 2. The tax amnesty shall only cover tax obligations for years 2012 and 2013, unless the City Mayor finds it necessary to extend the period by way of issuance of an Order which shall be made effective and operational upon receipt of a copy thereof by the Sangguniang Panlungsod. SECTION 3. To avail of the tax amnesty granted under this Ordinance, West Tower residents and business owners need to submit written request for amnesty to the City Treasurer who shall assess and rule on its approval after verification with the barangay inventory or master list duly certified by the Punong Barangay and verified by representative/s from the Business License Office and the City Assessor's Office of all the businesses and real property owners of West Tower Condominium. SECTION 4. This Ordinance shall take effect immediately upon its approval and posting in conspicuous places in Barangay Bangkal. SECTION 5. Let copy of this Ordinance be furnished the Permit Division, Assessor's Office, Accounting Department, Treasurer's Office, Budget Office, Punong Barangay of Bangkal and other departments/offices and agencies concerned for their information, guidance and reference.
