July 14, 2020 Excerpt from the Minutes of the Regular Session of the Sangguniang Panlungsod of the City of Maasin Held on July 14, 2020 at the Sangguniang Panlungsod Session Hall, Maasin City, Southern Leyte. EXPLANATORY NOTE AN ORDINANCE AMENDING SECTION 147, PAR. 2, AND SECTION 147.1 OF CHAPTER XII (TERMINAL AND PARKING CHARGES) OF CITY TAX ORDINANCE NO. 2015-015, OTHERWISE KNOWN AS THE REVISED REVENUE CODE OF THE CITY OF MAASIN AND FOR OTHER PURPOSES Introduced by: Hon. Zaldy L. Olita Chairman, SP Committee on Games, Amusements, Government Economic Enterprise Development and Management and DRRM City Tax Ordinance No. 2015-015, more particularly Section 147 par. 2, sub-par. 2, authorizes private vehicles to park at the Maasin Integrated Bus Terminal (MIBT) during night time for a fee; It has been observed that during daytime, vacant portions in different locations within the Maasin Integrated Bus Terminal, have been used as parking place for private vehicles and other vehicles not operated as public transportation without fee as the existing ordinance imposes a fee for night parking only; It is imperative that of private vehicles or any vehicle not operated as a public transportation within the Maasin Integrated Bus Terminal has to be regulated for an orderly flow of traffic and public transportation within the said terminal, while there is also a need for adjustment of terminal fees and charges, imposed on public transportation/utility vehicles (PUV) due to increase cost of maintenance. Thus, the need for an amendment of City Tax Ordinance No. 2015-015; MAASIN CITY TAX ORDINANCE NO. 2020-023 AN ORDINANCE AMENDING SECTION 147, PAR. 2, AND SECTION 147.1 OF CHAPTER XII (TERMINAL AND PARKING CHARGES) OF CITY TAX ORDINANCE NO. 2015-015, OTHERWISE KNOWN AS THE REVISED REVENUE CODE OF THE CITY OF MAASIN AND FOR OTHER PURPOSES BE IT ENACTED , by the Sangguniang Panlungsod of the City of Maasin, in Regular Session assembled, that: SECTION 1. Section 147, paragraph 2 of City Tax Ordinance No. 2015-015 , is hereby amended to read as follows: CAIHTE 1. x x x "2). Other Terminal Charges: 1. Public Transportation/Utility Vehicle (PUV) inside the Maasin Integrated Bus Terminal (MIBT) without any scheduled trip during the day shall be parked on the designated area and be collected with the following charges. a) Jeep/van P14.00 for the first hour plus P7.00 every 3 hours thereafter; b) Bus P35.00 the first hour plus P7.00 every 3 hours thereafter. 2. Private vehicles and other vehicles not operated as public transportation shall be allowed to park on a designated parking area within the Maasin Integrated Bus Terminal with the following rates: Daytime parking: 6:00 a.m. to 9:00 p.m. P20.00 for the first two hours plus P10.00 for every hour or portion thereof in excess of two hours; Nighttime parking: past 9:00 p.m. to before 6:00 a.m. P50.00; Cargo trucks and other vehicles with six wheels and more shall not be allowed parking at the designated pay parking area and any area within the MIBT. SECTION 2. Section 147.1 of City Tax Ordinance No. 2015-015 , is hereby amended to read as follows: " Section 147.1. Time of Payment the fee imposed for Terminal Fees (including Dispatching Fees) and Other Terminal Chases as stated in the preceding provisions, shall be paid to the City Treasurer, or his/her duly designated terminal collector/s, upon exit of the vehicle from the terminal or parking space, except night parking charges for private vehicles and non PUV units, the parking fees shall be paid upon parking." SECTION 3. Repealing Clause . All Ordinances and resolutions or parts thereof which are inconsistent with the provisions of this Ordinance are hereby repealed and modified accordingly. SECTION 4. Separability Clause . If for any reason or cause, any part or provision of this ordinance is declared to be unconstitutional, invalid or contrary to law, other part or provision thereof which are not affected thereby, shall continue to be in full force and effect. SECTION 5. Effectivity . This Ordinance shall take effect, after its publication in a newspaper of general circulation and after copies of this Ordinance shall have been posted for ten (10) days in the bulletin board, at the entrance of the City Hall Building, and in at least two (2) conspicuous places in the City of Maasin, not later than five (5) days after approval hereof.
