Sangguniang Bayan hinggil sa market fee schedules and some provisions upang matamang pag-aralan at suriin; ETHIDa SAPAGKAT , upang ganap na maisaayos ang mga kasunduan at mga alituntunin tungkol sa pagpapaupa sa bubuksang Pamilihang Bayan ng Lumban; SAPAGKAT , nararapat lamang na amyendahan ang mga dating butaw na nakasaad sa ilang Artikulo ng Chapter V "Municipal Charges & Other Fees" partikular ang tungkol sa mga pagpapaupa sa bubuksang Pamilihang Bayan dahilan sa ang mga ito ay hindi na naangko sa kasalukuyang pahahon; KUNG KAYA AT DAHIL DITO AY IPINASISIYA ng Kgg. Sangguniang Bayan, sa mungkahi ni Kgg. Rolando G. Ubatay at sinang-ayunan ng lahat ng nagsidalo, ay: IPINASIYA NA , pagtibayin ang kapasiyahan na nag-aamyenda sa imposition of fees ng Articles A, B at Article E, Chapter V ng The New Revenue Code 2000; IPINASIYA PA RIN , na pagtibayin ang isang Kautusang Bayan para dito: LUMBAN KAUTUSANG BAYAN BLG. 04, T. 2003 ORDINANSA NA NAG-AAMYENDA SA SECTION 5A.02 (A & B) 03 (A), 06 (A) AT 07 (F) NG ARTICLE A; SA SECTION 5B.01 (A-C) NG ARTICLE B; AT SA SECTION 5E NG ARTICLE C, CHAPTER V NG THE NEW REVENUE CODE 2000 PANGKAT I. Inaamyendahan ang Section 5A.02 (a & b) 03 (a), 06 (a) at 07 (f) ng ARTICLE A; Section 5B.01 (a-c) ng ARTICLE B; at Section 5E ng ARTICLE C, CHAPTER V ng THE NEW REVENUE CODE 2000. PANGKAT II. Ang layunin ng Kautusang Bayang ito ay ang mga sumusunod: 1. Upang ganap na maisaayos ang mga karampatang butaw ng bubuksang Pamilihang Bayan ng Lumban. 2. Upang tumugma ang mga kaukulang butaw sa kasalukuyang panahon. PANGKAT III. Inilalahad ang mga pag-amyenda sa Section 5A.02 (a & b) 03 (a), 06 (a) at 07 (f) ng ARTICLE A; Section 5B.01 (a-c) ng ARTICLE B; at Section 5E ng ARTICLE C, CHAPTER V ng THE NEW REVENUE CODE 2000 gaya ng sumusunod na pamamaraan: CHAPTER V. MUNICIPAL CHARGES AND OTHER FEES ARTICLE A. Market Fees Section 5A.02. Imposition of Fees. There shall be collected with the following fees: A. RENTAL FEE ON MARKET PREMISE WITH STALL: 1. On stalls with booth constructed by the municipal government, per square meter or fraction thereof, per month or fraction thereof. ATICcS STALLS Size Stall Fee/mo. 1. Dry 10.5 sq.m. P1,050.00 2. RENTAL FEE ON OTHER MARKET PREMISES WITHOUT STALLS/BOOTHS (TIYANGGE): 1. On occupants of market premises without stalls or booths per papag per day: TIYANGGE DAY P20.00/papag Wednesday Section 5A.03. Time and manner of payment. a. For stalls . Before occupancy of the stall, he/she shall pay one month deposit & two months advance . The fee for the rental of market stalls shall be paid to the Municipal Treasurer or his duly authorized representative within the first twenty (20) days of each month in which the lease starts. Section 5A.06. Adjudication of Stall. a.) Lease Period . The contract of lease for a stall shall be for a period of three (3) years, renewable upon expiration, unless revoked in accordance with the provision of the Article. aDSIHc Section 5A.07. Miscellaneous Provisions on Stalls. f.) Creation of Market Committee: There is hereby created a permanent market committee composed of the Municipal Mayor as chairman, the Municipal treasurer, a representative of the Sangguniang Bayan and a representative of the market vendors as members whose duties are to conduct the drawing of lots and opening of bids in connection of vacant or newly constructed stalls or booths in the market. g.) Construction Cost Share per Stall: Occupants shall pay his/her construction cost share in the following manner: STALL AMOUNT/Stall 1. Dry Section P20,000 00 2. Wet Section 10,000.00 3. Eatery Section 15,000.00 Article B. Slaughter and Corral Fees Section 5B.01. Imposition of Fees. Ano man ang nasasaad sa mga probisyon ng The New Revenue Code 2000 na hindi nasasakop ng amyenda ng ordinansang ito ay magpapatuloy na may bisa liban kung ang mga iyon ay may nilalabag na mga umiiral na batas at ordinansa. PANGKAT V. Inaatasan ang Pambayang Ingat Yaman na ipatupad ang ordinansang ito. PANGKAT VI. Inaatasan din ang Nanunuparang Kalihim na padalhan ng sipi ang lahat ng mga kinauukulan para sa kanilang kabatiran at kaukulang aksiyon. PANGKAT VII.
