WHEREAS, R.A. 9640 entitled an Act Amending Section 140 (a) of R.A. 7160, otherwise known as the Local Government Code of 1991 was passed on May 21, 2009 and became effective on August 25, 2009; WHEREAS, the said law amended the previous amusement tax ceiling from 30% to not more than ten percent (10%); WHEREAS, Resolution No. 14-614 was adopted by the City Council of Lucena on December 7, 2009 but was not accepted by the City Treasurer since she believed that the adoption of R.A. 9640, "AN ACT AMENDING SECTION 140 (A) OF R.A. 7160" should be made through an enactment of an Ordinance and not through a Resolution; WHEREAS, to comply with the provision of R.A. 9460, there is a need to amend Section 2.6.02 of Ordinance No. 2285, Series of 2008, ENACTING THE 2007 LOCAL REVENUE CODE OF LUCENA CITY that levies an amusement tax at the rate of fifteen percent (15%); HCSDca WHEREAS, R.A. 9640, having been duly enacted and published, it now has the force and effect of law, thereby enjoining the City Treasurer and other concerned offices to implement the said laws and reduce the ceiling rate accordingly; NOW THEREFORE, on motion of Coun. Wilfredo F. Asilo, duly seconded by Couns. Felix F. Avillo and William M. Noche RESOLVE, as it is hereby RESOLVED, to enact the following ordinance; LUCENA CITY ORDINANCE NO. 2396-10 AN ORDINANCE AMENDING SECTION 2.6.02 OR ORDINANCE NO. 2285, SERIES OF 2008 OTHERWISE KNOWN AS THE 2007 LOCAL REVENUE CODE OF LUCENA CITY Be it ordained by the Sangguniang Panlungsod of Lucena in session assembled, that: EaScHT SECTION 1. Section 2.6.02 of Ordinance No. 2285, Series of 2008, is hereby amended to read as follows: FROM SEC. 2.6.02. Imposition of Tax . There is hereby levied a tax to be collected from the proprietors, lessees, or operators of theaters, cinemas, concert halls, circuses, boxing stadium and other places of amusement at the rate of fifteen percent (15%) of the gross receipts from admission fee; TO SEC. 2.6.02. Imposition of Tax . There is hereby levied a tax to be collected from the proprietors, lessees, or operators of theaters, cinemas, concert halls, circuses, boxing stadium and other places of amusement at the rate of ten percent (10%) of the gross receipts from admission fee; SECTION 2. Effectivity . This ordinance shall retroactively take effect on January 1, 2010. UNANIMOUSLY ENACTED: I HEREBY CERTIFY to the correctness of Ordinance No. 2396, Series of 2010, entitled: AN ORDINANCE AMENDING SECTION 2.6.02 OR ORDINANCE NO. 2285, SERIES OF 2008 OTHERWISE KNOWN AS THE 2007 LOCAL REVENUE CODE OF LUCENA CITY, which was duly enacted by the City Council during its regular session held on September 13, 2010.
