February 4, 2013 LANAO DEL NORTE RESOLUTION NO. 042-13 Excerpts from the Minutes of the Regular Session of the Sangguniang Panlalawigan of Lanao Del Norte Held at the Sangguniang Panlalawigan Session Hall, Provincial Capitol Building, Pigcarangan, Tubod, Lanao Del Norte, on February 4, 2013. Tawantawan Member A RESOLUTION AMENDING SECTIONS 146, 149, 150 AND 151 OF THE PROVINCIAL ORDINANCE NO. 001-2006, OTHERWISE KNOWN AS "THE PROVINCIAL REVENUE CODE OF LANAO DEL NORTE OF 2006" WHEREAS, Hon. Mohammad Moamar Jack S. Maruhom, Chairman, Committee on Ways and Means, reported for deliberation of the Sangguniang Panlalawigan the passage of an ordinance amending Sections 146, 149, 150 and 151 of Provincial Ordinance No. 001-2006, otherwise known as "The Provincial Revenue Code of Lanao del Norte of 2006", relative to the Rental Rates of Economic Enterprise Projects of the Provincial Government of Lanao del Norte; WHEREAS, one of the major global trends energizing public sector financing is broadening the sources of revenue that usually fund government programs and services. Normally, public funds only come from taxes and custom levies. Nowadays, funds from revenue generating projects and initiatives are increasingly impacting on the depth and scope of government programs; WHEREAS, the committee recommended to approve the request to amend Sections 146, 149 and 150 and 151 of the Provincial Ordinance No. 001-2006, otherwise known as "The Provincial Revenue Code of Lanao del Norte of 2006" relative to the Rental Rates of Trucking Services and Farm Equipment, Fees and/or Charges for Hospital Private Rooms, Fees/charges or rental for the use of the Macapagal Training Center and Fees/charges or rental for the use of the facilities of the Mindanao Civic Center of the Provincial Government of Lanao del Norte in order to generate additional revenues for the implementation of development programs for the people of Lanao del Norte. NOW, THEREFORE, after due deliberation on motion of HON. MOHAMMAD MOAMAR JACK S. MARUHOM, Chairman, Committee on Ways and Means, unanimously seconded by all of the members present, it was RESOLVED, by the Sangguniang Panlalawigan of Lanao del Norte in session assembled to pass and enact TADaCH PROVINCIAL ORDINANCE NO. 001-2013 "AN ORDINANCE AMENDING SECTIONS 146, 149, 150 AND 151 OF THE PROVINCIAL ORDINANCE NO. 001-2006, OTHERWISE KNOWN AS "THE PROVINCIAL REVENUE CODE OF LANAO DEL NORTE OF 2006" Be it ordained by the Sangguniang Panlalawigan of Lanao del Norte in session assembled, that: SECTION 1. Title . The Ordinance shall be known as "An Ordinance Amending Sections 146, 149, 150 and 151 of Provincial Ordinance No. 001-2006, otherwise known as "The Provincial Revenue Code of Lanao del Norte of 2006." SECTION 2. Amendments . That Sections 146, 149, 150 and 151 of the Provincial Internal Revenue Code shall now read as follows: SEC. 146. The Rate of Rental. There shall be collected from the lease of all heavy or road buildings and farm equipment of the Provincial Government of Lanao del Norte a uniformed rate of rental for government and private users as prescribed hereunder; SEC. 149. The Fees and/or Charges for Hospital and Medical Services and the Use of Hospital Facilities and Supplies. There is hereby levied and to be collected by the Province of Lanao del Norte for the hospital and medical services and the use of hospital facilities and supplies as prescribed and/or provided hereunder: (b) n Provincial Grains Processing Center (PGPC) Trucking Services For commercial use by clients (private): Mini Dump Truck Isuzu Forward P50.00/km maximum loading P100/km maximum loading capacity of 3.5MT or 60 bags capacity of 10MT or 220 bags (Fuel, lubricants & other incidental (Fuel, lubricants & other incidental expenses charged to (PGLN) expenses charged to (PGLN) (c) Provincial Grains Processing Center (PGPC) Trucking Services For pakyaw basis (private): Mini Dump Truck Isuzu Forward P2,000.00/day exclusive of fuel & oil P4,000.00/day exclusive of fuel & oil (maximum loading capacity of 3.5MT (maximum loading capacity of 10MT 60 cavans) 220 cavans) (d) Farm Tractor Services Harrowing P2,800.00/ha/pass within Tubod P3,000.00/ha/pass outside Tubod Disc Plowing P3,800.00/ha/pass within Tubod P4,000.00/ha/pass outside Tubod Tractor Operator 11% share per hectare (d) PGLDN HOSPITAL PRIVATE ROOMS SEMI-PRIVATE NON-AIRCON P600.00 PER PATIENT SEMI-PRIVATE AIRCON P700.00 PER PATIENT PRIVATE ROOM (SINGLE-AIRCON) P1,200.00 SEC. 150. If, for any reason, any provision, section or part of this Ordinance is declared invalid by a court of competent jurisdiction, such judgments shall not affect or impair the remaining provisions, sections or parts, which shall continue to be in full force and effect. SECTION 5. Repealing Clause . All previous ordinances, rules and regulations, or parts hereof, which are inconsistent with any provisions of this Ordinance, are hereby repealed or modified accordingly. SECTION 6. Effectivity . This ordinance shall take effect after ten (10) days from its publication in the newspaper of general circulation in the province and a copy thereof shall be posted in conspicuous places in the Provincial Capitol and in the Municipal Hall of the twenty two municipalities of this province.
