An Ordinance Amending City Ordinance No. 185, Series of 2004 (As Amended by City Ordinance Nos. 2007-043 and 2007-052)

October 21, 2009 LA CAROTA CITY ORDINANCE NO. 082-09 AN ORDINANCE AMENDING CITY ORDINANCE NO. 185, SERIES OF 2004 (AS AMENDED BY CITY ORDINANCE NOS. 2007-043 AND 2007-052), OTHERWISE KNOWN AS THE REVISED CITY REVENUE CODE OF LA CARLOTA CITY BE IT ORDAINED by the Sangguniang Panlungsod of the City of La Carlota in its regular session assembled and on motion by Hon. Jeffrey E. Rumbines, jointly seconded by Hons. Rosalinda L. Aguirre, Ruel G. Alvaez, Ciriaco D. Sia, Jr., Jacob E. Liansing, Manuel R. Badillo and Erwin Ponce, Jr. SECTION 1. Amendment . Article I-1 shall be inserted to City Ordinance No. 165, Series of 2004, otherwise known as the Revised Revenue Code of La Carlota City. The sub-title of Article I-1 shall be "Birthing Clinic Institutional Fee and User's Fee." SECTION 2. Definition of Terms . Below are the definition of terms: a. Institutional Fee means a charge imposed upon the student for the use of the facilities and premises of birthing clinic owned and managed by the City Government of La Carlota as base clinic of a school or educational institution offering various health related disciplines as cited in Section 3 of this Ordinance with priority in the schedule of training/exposure. b. User's Fee means a charge imposed upon the transient student for the use of the facilities and premises of birthing clinic owned and Managed by the City Government of La Carlota City for training, exposure and other related purposes. c. Student is a person enrolled with the Colleges/Universities who have valid and existing contract with the City Government of La Carlota that the City Birthing Clinic is their "base clinic." d. Transient Student is a person enrolled with the Colleges/Universities who have valid and existing contract with the City Government of La Carlota that the City Birthing Clinic as one of their training centers. e. DOH means Department of Health. SECTION 3. Imposition of Fees . The following fees shall be charged: A. Institutional Fee: A.1. Group I P500 per Student per semester or fraction thereof. A.2. Group II P200 per Student per semester or fraction thereof. A.3. Group III 50% of the fee being charged to Group I or Group II depending on degree/discipline. B. User's Fee: B.1. Group I P1,000 per Transient Student per semester or fraction thereof. B.2. Group II P500 per Transient Student per semester or fraction thereof. Legend: Group I Students of any 4 years and above degree/discipline Group II Students of any degree/discipline below 4 years Group III Students enrolled with City College owned by City Government of La Carlota SECTION 4. Creation of Trust Fund . The fees collected shall be formed part of the Trust Fund of the City Health Office created under the provisions of City Ordinance No. 2007-050, otherwise known as "an Ordinance establishing the City Birthing Clinic and defining its functions, operations and administration." SECTION 5. Distribution of Fees . Distribution of fees shall conform with existing DOH Administrative Order No. 5-A, series of 1996 or any future Administrative Order to be issued by DOH to this effect. SECTION 6. Separability Clause . If for any reason, any provision, section or part of this Ordinance is declared not valid by a proper government agency or the court of the competent jurisdiction, such judgment shall not affect or impair the remaining provisions, sections or parts hereof, which shall continue to be force and effect. SECTION 7. Repealing Clause . All ordinances, resolutions, rules and regulations, or part thereof, whose provisions are in conflict with or contrary to the provisions of this Ordinance are hereby deemed repealed, amended and modified accordingly. SECTION 6. Effectivity . This Ordinance shall take effect upon its approval and after due compliance with publication requirements.
