KALIBO MUNICIPAL ORDINANCE NO. 034-16 AN ORDINANCE AMENDING SECTION 3A.01 (NO. 19), ARTICLE A OF CHAPTER III-PERMIT AND REGULATORY FEES OF REVENUE ORDINANCE NO. 2014-21 Sponsors: Hon. Daisy S. Briones, Hon. Augusto C. Tolentino, Hon. Arnaldo M. Tejada, Hon. Rodillo L. Policarpio, Hon. Ariel O. Fernandez WHEREAS, Revenue Ordinance No. 2014-21, "An Ordinance Enacting Local Revenue Code of Kalibo, Aklan" was enacted by the Sangguniang Bayan in December 18, 2014 as a revision to 2006 Revised Revenue Code of Kalibo; WHEREAS, Section 3A.01 No. 19, Article A, Chapter III of said Revenue Ordinance provides assessment of fees/charges for the payment of Mayors Permit for transport sector particularly on public utility vehicles that operates in the Municipality of Kalibo; WHEREAS, some transport groups submitted a petition for the reduction of Mayors Permit Imposition which was referred to the Ways and Means Committee who called a Meeting inviting the presence of the Local Finance Committee for financial analysis and evaluation vis a vis the financial position of the LGU if the petition is given due course. Meanwhile awaiting the financial analysis and recommendation the Sangguniang Bayan thru Resolution No. 2016-397 extended the deadline of payment for transport fees and charges without penalties and surcharges until March 15, 2016; WHEREAS, the Sangguniang Bayan in the exercise of its legislative duties and obligations thru its Committee on Ways and Means together with the Local Finance Committee held a dialogue to present the financial position of LGU vis vis the petition for reduction. The transport sector ventilated their sentiment and explained the economic plight of transport groups and after exchange of ideas and positions, the pros and cons professed by contending parties, a reduction of 50% from the existing rate was initially recommended by the Local Finance Committee which is believed mutually beneficial to the general public and the transport group; WHEREAS, the Local Finance Committee on its February 19, 2016 meeting finally proposed a Resolution recommending the reduction and/or amendment of existing rates as herein below ordained; NOW THEREFORE, be it ordained by the Sangguniang Bayan in session duly assembled that: SECTION 1. Article A Section 3A.01 (No. 19) Chapter III of the Local Revenue Code of Kalibo enacted December 18, 2014 is hereby amended to read as follows: "19. On operators of public utility vehicles maintaining principal booking office, terminal/garage, waiting station for the purpose of doing business in carrying passengers from this municipality under a certificate of public convenience and necessity or similar franchises: From To a. Van for Hire 2,500.00/unit 1,250.00/unit b. Air-conditioned buses 5,300.00/unit 2,650.00/unit c. Buses without air conditioning 2,550.00/unit 1,275.00/unit d. "Mini" Buses 2,550.00/unit 1,000.00/unit e. Jeepneys/Multicab 2,550.00/unit 1,000.00/unit f. Taxis/Car for Rent 1,550.00/unit 1,000.00/unit g. Vessel for Hire 1,550.00/unit 1,000.00/unit h. Motorcycle for Rent 550.00/unit 275.00/unit i. Tricycle for Hire 120.00/unit 120.00/unit " SECTION 2. That the excess payment of members of transport sector that has already paid their Mayor's Permit for CY 2016 based on the original rate shall be credited on their next payment/renewal and be taken as an advance payment. SECTION 3. Repealing Clause . Any and all previous ordinance/s, administrative orders, rules and regulations or part thereof that are inconsistent with this ordinance are hereby repealed or modified accordingly. CAIHTE SECTION 4. Separability Clause . If for any reason, any section of this ordinance shall be held unconstitutional or invalid other sections which are not affected thereby shall continue to be in full force and effect. SECTION 5.
