June 21, 1972 REVENUE MEMORANDUM CIRCULAR NO. 30-72 SUBJECT : Requiring the Filing of Criminal Complaints Against Government Personnel Charged Administratively where the Administrative Case Involves Dishonesty, Corruption or Moral Turpitude TO : All Internal Revenue Officers, Employees and Others Concerned For the information and guidance of the officers and employees of the Bureau of Internal Revenue, there is quoted hereunder Department Memorandum Circular No. 11-72 dated May 11, 1972: "Republic of the Philippines DEPARTMENT OF FINANCE Manila "DEPARTMENT MEMORANDUM CIRCULAR NO. 11-72 May 11, 1972 "TO : All Heads of Bureaus and Offices under the Department of Finance and Local Treasury and Assessment Offices SUBJECT : Requiring the filing of criminal complaints against government personnel charged administratively where the administrative case involves dishonesty, corruption or moral turpitude. "Quoted hereunder, for your information and guidance, is Executive Order No. 390 dated April 26, 1972, on the above subject-matter: 'WHEREAS, it has been observed that some government personnel have been charged administratively without the corresponding criminal complaints being filed against them, despite the fact that the offense involves dishonesty, corrupt or immoral acts punishable under penal laws; 'WHEREAS, such omission is not conducive to good government, as it enables dishonesty or corrupt respondents to avoid the penal sanction of the law in proper cases; and 'WHEREAS, sound public administration demands that the full force of the law be brought to bear upon erring government personnel to upgrade the public service and to enhance the people's faith in the Government. 'NOW, THEREFORE, I FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby require that in all instances where administrative cases involving dishonesty, corruption or moral turpitude are filed against government personnel, the corresponding criminal complaints must be filed against such erring personnel, Department Secretaries and heads of government agencies, national and local, shall see to the due enforcement or implementation of this Order. 'Done in the City of Manila, this 26th day of April, in the year of Our Lord, nineteen hundred and seventy-two.' "Strict compliance herewith is hereby enjoined, especially by those concerned with the administrative discipline of officials and employees in your respective offices. "(SGD.)
