Pacquiao City Councilor (President, Liga ng mga Barangay) (OL) WHEREAS, the Sangguniang Panlungsod enacted Ordinance No. 01, Series of 1996 approving the 1996 Revenue Code of the City of General Santos; WHEREAS, No. 4, Section 56, Article K of the said ordinance provides for the process flow of application for quarry or extraction permit; WHEREAS, there is a need to amend No. 4, Section 56, Article K of the said ordinance so as to conform with Republic Act No. 7942, Republic Act No. 7076, their implementing rules and regulations, other pertinent laws and city ordinances governing and pertaining to the administration, control and disposition of mineral resources and quarry operations within the jurisdiction of the City of General Santos; NOW, THEREFORE, on motion of City Councilor Ramon R. Melliza, duly seconded by City Councilors Rosalita T. Nuez, Shandee Theresa O. Llido-Pestao and Brix T. Tan, be it RESOLVED, as it is hereby resolved to enact this Ordinance: GENERAL SANTOS CITY ORDINANCE NO. 017-14 AN ORDINANCE AMENDING NO. 4, SECTION 56, ARTICLE K OF ORDINANCE NO. 01, SERIES OF 1996 OTHERWISE KNOWN AS THE GENERAL SANTOS CITY REVENUE CODE OF 1996 Hon. Ramon R. Melliza Sponsor; Hon. Shandee Theresa O. Llido-Pestao Co-Sponsor Be it ordained by the Sangguniang Panlungsod, City of General Santos, that: SECTION 1. No. 4, Section 56, Article K of the General Santos City Revenue Code of 1996 is hereby amended to read as follows: 4. Composition, Function of the City Mining and Regulatory Board. The City Mining and Regulatory Board (CMRB) shall be composed of the Mines and Geo-Sciences Bureau (MGB) of the Department of Environment and Natural Resources (DENR), the Regional Director why as chairperson, could attend meetings personally or through his duly authorized representative, the representative of the city mayor, one (1) small scale mining representative, one (1) big-scale mining representative, and the representative from a non-government organization who shall come from an environment group, as members. The representatives from the private sector shall be nominated by their respective organizations and appointed by the City Mayor. They shall provide the staff support to the Board. The Board shall in the conduct of its affairs be governed by Republic Act No. 7942, Republic Act No. 7076, and their implementing rules and regulations, applicable and pertinent Department Administrative Orders of DENR-MGB and other pertinent laws, issuances and city ordinances governing and pertaining to the administration, control and disposition of mineral resources and quarry operations. The City Mining and Regulatory Board shall, among others, accept, process and evaluate applications and determine administrative charges and fees for quarry, sand and gravel, guano, gemstone gathering and small-scale mining permits duly filed with the same. On top of the above-mentioned laws, pertinent and relevant provisions of this ordinance on quarry operations shall be observed. Process Flow of Applications for permit Applications for quarry or extraction permit shall be processed as follows: Step 1 Application for permits shall be filed with the Office of the City Mayor through the City Mining Regulatory Board (CMRB); Step 2 The CMRB conducts its evaluation of the request taking into consideration other existing and applicable laws, rules and regulations; Step 3 If the application is found in order, the application shall be endorsed favorably to the chief executive for perusal and approval. If not in order, the application shall be returned to the applicant with explanation why the application cannot be granted and/or the list of deficiency. Step 4 Applications endorsed favorably by the CMRB, if the Chief Executive finds it in order, shall be endorsed to the Permits and Licenses Division of the City Mayor's Office of the City for issuance of permit/license. Step 5 Assessment shall be done by the City Treasurer and the applicant pays the required fees and taxes with the Office of the City Treasurer. Step 6 The Permits and Licenses Division forwards the permit for approval/signature of the Chief Executive after payment of all fees, taxes and charges submission of requirements. SECTION 2. Repealing Clause. All ordinances, resolutions, memoranda, orders and similar issuances, or part or parts thereof which are inconsistent with any of the provisions of this Ordinance are hereby repealed or modified accordingly. SECTION 3. Effectivity Clause. This Ordinance shall take effect after 10 days following the completion of its full publication in any newspaper of general circulation within General Santos City.
