Acharon City Councilor (OL) WHEREAS, this Sanggunian is in receipt of official communication from the Office of the City Mayor dated 18 August 2009, thereby requesting enactment of measures that would provide for procedures and sanctions to business establishments operating without the necessary business permits; aTIAES WHEREAS, in response to the above request, this Sanggunian deems appropriate to amend certain provisions of City Ordinance No. 01, Series of 1996, otherwise known as General Santos City Revenue Code of 1996 for such to become more responsive to present problems occurring in the field; NOW, THEREFORE, on motion of City Councilor Jose Mariano Constantino G. Gonzalez, duly seconded by City Councilors Vivencio E. Dinopol, Richard L. Atendido, and Margareth Rose N. Santos, be it RESOLVED, as it is hereby resolved, to enact the following Ordinance: GENERAL SANTOS CITY ORDINANCE NO. 009-09 AN ORDINANCE AMENDING SECTION 66, ARTICLE A, CHAPTER III OF ORDINANCE NUMBER 01, SERIES OF 1996, OTHERWISE KNOWN AS GENERAL SANTOS CITY REVENUE CODE OF 1996 Hon. Jose Mariano Constantino G. Gonzalez Sponsor Be it ordained by this Sangguniang Panlungsod that: SECTION 1. The 1st Paragraph of Section 66 (a), Article A, Chapter III of Ordinance Number 01, Series of 1996, otherwise known as General Santos City Revenue Code, which reads: (a) Permit requirements . It shall be unlawful for any person to engage in any business or occupation for which a permit is required for the proper supervision and enforcement of existing laws and ordinances governing sanitation, security and welfare of the public and health of the employees. In the businesses, trades or occupations under this ordinance and other ordinances that may herein after be enacted without first having secured a permit therefore from the city mayor and pay the corresponding fees to the city treasurer is hereby amended, thus, shall, henceforth, read as follows: "(a) Permit Requirements. It shall be unlawful for any person or entity to engage in any business, trade or occupation without first securing a permit from the office of the city mayor after paying the corresponding fees to the office of the city treasurer, as required under this Ordinance and other ordinances that may hereinafter be enacted for the proper supervision and enforcement of existing laws and ordinances governing sanitations, security, public welfare, and health of employees." SECTION 2. There is hereby added to Section 66, Article A, Chapter III, Administrative Provisions, of the same Code the following provisions to, henceforth, form part and parcel thereof, to wit: "(i) Sanctions on Businesses Operating without the Required Permit Any business establishment operating without a permit shall be given a written notice of violation of Section 66(a) hereof with a warning that a permit should be secured within a period of one (1) month from notice. The notice must be visibly printed and it shall be posted in a conspicuous place inside the business establishment. Removal of which shall be a ground for permanent closure of said business establishment. If upon lapse of the one (1) month period, the said business establishment fails to secure the necessary permit, the office of the city mayor shall issue a permanent closure order which shall immediately be implemented by the permits and license division." SECTION 3. Amendatory Clause . The provisions of previous local enactments, resolutions, memoranda, circulars, and other issuances inconsistent with this Ordinance are hereby repealed or modified accordingly. EAHcCT SECTION 4. Separation Clause . In the event that a provision of this Ordinance is found or decreed to be invalid or unconstitutional, all other provisions hereof not affected by such pronouncement or decree shall remain to be in full force and effect. SECTION 5. Effectivity Clause . This Ordinance shall take effect after fifteen (15) days following the completion of its full publication in any newspaper of general circulation within General Santos City.
